Glendale business group files lawsuit vs. sales-tax hike

A business group aiming to overturn Glendale's 0.7 percent sales-tax hike filed a lawsuit against the city Friday, claiming it rejected petition documents "based on several misinterpretations of the law."

In a statement released Friday, Save Glendale Now Chairman Rod Williams said he is "outraged that two unelected officials, the city clerk and the city attorney, would attempt to trample on the rights of every Glendale citizen to exercise his or her initiative rights as enshrined in the Arizona Constitution."

Dave Kimmerle, president of Sanderson Ford and Save Glendale Now leader, said it's "amusing" that Tindall believes voters were misled.

"Every petition circulated contained the full text of the initiative for every voter to read," he said in the statement. "It doesn't take a law degree to read the initiative and understand what it does."

Can someone alter the thread title when Phoenix gets relocated to Quebec?

I'm pretty much at my limit for 'ballot initiatives' that no one seems to uderstand.

Glendale rejects petitions in referendum of Phoenix Coyotes deal

The duo is weighing whether to file a legal challenge seeking to get the measure on the ballot. State law requires they decide within five days.

Jones said even if they decide not to sue Glendale, they plan to continue fighting the city's deal with Jamison.

He said there could be a grass-roots push to add a $30 surcharge to Coyotes tickets or other measure to generate revenue "until hockey costs are removed from Glendale's taxpayers.

So with the surcharge, the price breakdown for a ticket looks something like:

. Ticket - $12
. Ticketmaster fee- $18
. COG usuary fee - $30

Total cost of attending a yotes game $60.......

You really think some 80 year old man will get a $30 ticket surcharge on tickets?? how the hell do you expect him to pull that off? Really, the referendum deal was their ONLY hope and they were given bad advise by the GWI. They thought all they needed was the 1,100 ish signatures when in reality they needed over 1,800 and they did come close and probably would've hit that number if @glendalefirst didn't start dissuading people and providing facts as to what they were signing up for.

$30 "surcharge" is amusing. What they are really saying is "just raise prices, that will fix everything!"

We saw the reaction here when the Flames raised tickets by 4-8%. A $30 surcharge in Phoenix would be a 12%-300% increase, depending on section.

Supporters of an effort to reverse Glendale’s sales-tax increase must wait nearly a month to argue before a judge.

Last week, the city rejected signatures submitted by the business group which aims to get an initiative on the November ballot. The group, Save Glendale Now, responded with a lawsuit. A Glendale spokeswoman confirmed Tuesday that the city and the business group won’t appear before Maricopa County Superior Court Judge Sally Duncan until Aug. 14.

Once in court, Glendale will argue the 100-word summary submitted with the group’s 4,138 signatures was misleading because an initiative cannot reverse the Glendale City Council’s vote to increase the city sales tax by 0.7 percent. The city has also said the group failed to include a serial number on each petition and submit them four months before the Aug. 28 primary election.

In its lawsuit filed last week, the business group said the city clerk did not have discretion to reject the petitions and that the loopholes cited by the city failed to take specific rules into account.

I think things will remain real quiet until we know how the CBA is turning out. Obviously it could mean a lot to the profitability of this franchise.

Even if Jamison got it now under this one, they wouldn't be able to stay here long. It's just a band-aid on a broken limb. They're raising ticket prices in a market where no one is showing up anyway? Haha, that'll work.

Court date on Glendale sales-tax initiative bumped up to July 30

Glendale officials have said the sales tax increase, which would bring in an estimated $20 million, is essential to avoid severe cuts.

Last month, interim City Manager Horatio Skeete said the city might have to consider whether it can afford this year's $17 million arena management fee to likely Phoenix Coyotes buyer Greg Jamison should the tax be overturned.


Interesting timing. Jamison was given until July 31st to close the deal by the NHL.

That's a whole hell of a lot different than what you stated above.. you said Jamison was given the deadline but you quote that Glendale was given the deadline.

Glendale's end of the business is done really.. (Minor court Spats aside) they did what they needed to. The rest is in the hands of Jamison and the NHL are they going to give themselves a deadline?
