I feel sorry for the Coyotes team. They've got a good shot at beating Chicago and will have to deal with the location instability throughout the playoffs again. Here's hoping they can put it behind them and win some games.

How are you getting to the conclusion that the offer was reasonable simply because a judge said that it was legally acceptable? You keep making this ridiculous leap based upon a judge saying that the offer wouldn't be rejected by the court. You need to grasp that an offer being legally acceptable and an offer being reasonable to the seller are not the same thing.

The NHL wasn't the seller, they were one of two competing bidders. The judge was representing the sellers or creditors. That the NHL had bylaws in place swung the decision in their favour.
That the NHL didn't like Balsillie's offer doesn't mean it wasn't a good offer.
Just from the CoGs position, they would have gotten $50M from Balsillie, instead they are now out $50M for a $100M difference.

You said there were no legal problems. Direct quote. If that was the case, why didn't the judge simply award Balsillie the team and right to move, given that his proposal had the greatest financial benefit to the creditors?
Of course Baum wanted them to negotiate. If Balsillie could convince the league his plan was good, then the creditors win. Balsillie failed (yet again), and as such Baum could not legally rule in his favour.

Except that I am not aware of anyone willing to own a team in Portland. Unless you are thinking as a temporary home until Seattle gets a rink built. But that would not change my argument, as the issue of a temporary venue is probably the least of the concerns for the potential owners in other markets. It is the amount of work necessary to build the organization on the ground.

Everyone had a chance to negotiate.
Balsille had the chance to change his terms, he chose not. Had he altered his bid to include provisions for keeping the team in Phoenix for a certain period of time based on attendance etc. he's likely the owner today. The fact is that he came in with an all or nothing approach and refused to budge from it. How do you negotiate with that?

If I remember rightly the NHL was also argueing that it was the owner as the franchise rules automatically defaulted the team to the league in the event of a bankruptcy. I stand to be corrected on this but I think they were arguing that the team wasn't legally in bankruptcy

Anyone listen to Maher on the fan this morning? At the end of his segment he said he's heard the most promising deal for Phoenix has fallen through, and the team is likely to be moved to Quebec. The league is keeping a wrap on things while the Coyotes are in the playoffs.
