Huh? Placing a deposit doesn't guarantee you anything, all it does is protect the seller from flakes like Philly. A seller can just as easily decide not to go through with things deposit or not, all that changes for you is the extra headache of getting your deposit back. the presence of a deposit doesn't make their obligation any stronger.

Story is kind of unravelling a bit no? The whole they called me that night at dinner portion wasn't just a minor detail. We're supposed to believe you when you can't figure out the difference between being called at 8pm while at dinner and 9:30 the next morning?

As of now I have you pegged as someone with pretty low character, both for the way you handled this and the way you've spun the story since. The repeated calls, if true, are way overboard but your behavior is completely unacceptable if you consider yourself an adult.

Maybe it was posted before but they made you aware that it was going to take about 2 hours before ordering weren't you? regardless how long it really takes to make a custom cake, you knew they were going to take longer and could run into your dinner plans and still ordered it. i think you should pay for it. it's still unreasonable for them to call you so many times though and i'm sure there is some other passive aggressive way for you to take it out on them (like slag them on a message board).

Don't places like this usually have a 24 hour cancellation requirement. If you order for that same day, as I understand this is, you pretty much can't cancel no matter how much you want.

The whole, oh they didn't call me that night, they called me the next morning is a huge thing for me. In other words they had pretty much left it to the OP to be responsible and pick up the order.

Beyond that, does anyone else wonder about someone who goes to pick up a high end customized cake from a specialty oriental bakery shop as a gift for his significant other, then at the last minute cancels it and goes to Safeways to pick up a run of the mill cake?

How romantic.

"Oh pookey you got me a cake from Safeways, was the gas station on the corner out of twinkies?"

While the number of phone calls is excessive, you ordered a custom cake after it had already been made. It's like at a restaurant, you're sitting there and you ordered something but try to cancel it after it's already been made. Food goes bad and if no one orders the same thing as you within like 15 minutes, it'll probably go to waste. You ordered it, its going on your bill regardless of whether you eat it or not. Stop whining about it like a spoiled child and just pay for it like any normal decent person would have.

Seems to me both parties are being jerks in this case. I can see why the OP doesn't want to give the store money but clearly his karma is in need of repair - so take the cost of the cake ($40) and donate it to Calgarypuck instead.

Win-win.

If I tell someone I am going to do something I will do it. This reminds me of someone who says they will do something then changes their mind if something better comes up. If I told that baker I would be back for the cake I would do it. No matter what happened. The thought of going somewhere else for a cake and then phoning him back to cancel wouldn't have even crossed my mind. Unless it was under a half hour maybe. It's like you started plan A in action, commenced with plan B, and then wanted to abort plan A, screwing an honest baker.

It wasn't even last minute, he purchased it at 4:10, had plans for 6:00. Had he waited until the last minute, he would have went to safeway at 5:45 instead of 4:30 when he realized the cake wouldn't be ready in time.

It reaks of OP not wanting to spend that much money on a custom cake, changed his mind 20 minutes later and went to safeway. He then called Yamato (likely when he was still nearby) instead of going in person to avoid potential conflict or embarassment for cancelling the order. Surely Yamato had some cakes ready to go, similar to what he purchased at Safeway.

The whole thought process there doesn't make sense.

We've ordered cakes from CakeWorks in the NE on several occasions, and have never been asked for a deposit. It can't just be a Japanese thing. And Cakeworks certainly couldn't just easily scrape the cake and redecorate if you didn't come pick it up. The whole cake is decorated to match the theme of whatever you put on it, on all sides. Plus, it can't be as easy to scrape off a actuall cake cake vs a frozen ice cream cake. The frozen ice cream will maintain it's shape with a little bit of force applied to it. Plus, if it's a little out of shape, they could just reshape it by adding ice cream where needed and refreezing.

An actual baked cake though? I'm not a baker, but I can't imagine scraping icing off of a cake without destroying it.

And I have no idea why you'd settle for a Safeway cake after having a custom cake on order. It's not like a custom cake costs much more than a generic Safeway one.
