Yamato Dessert Harassment Service
Timeline:
Yesterday 4:10pm. I walk into Yamato Dessert Cafe, and request to make a custom-made mango mousse birthday cake for my girlfriend. Yamato makes the most delicious Asian cakes that my girlfriend loves. I am told it will be 1.5-2 hours to have the cake made. Cakes usually take 30 minutes to make, but the chef has a large order that he has to work on before he can make my cake. I am hesitant -- I have dinner plans for 6pm -- but I tell them okay. They tell me they do not require a deposit, and I can pay when I pick up the cake.
Yesterday, 4:30pm. I change my mind, and buy a Tiramisu cake from Safeway, which the GF also loves. I phone Yamato to cancel my order, but there is no answer. I phone again 5 minutes later, still no answer, but I leave a voicemail saying I want to cancel my order and I will not be picking it up.
Yesterday, 8:00pm. Yamato phones me. I'm at dinner, and don't pick up. They leave me a message saying that my cake is ready, and ask why I haven't picked it up yet.
Today, 10am. Yamato phones me. This time I pick up. They repeat that my cake is ready, and ask why I haven't come to pick it up. I tell them that I had phoned them, and left a message to cancel the order. They tell me that I can't cancel my order, and that I have to pick up my cake. I tell them that I'm busy right now, but I might come by later to pick up the cake. I abruptly hang up on them.
Today, 10am - 2pm. Yamato has phoned me 80 (EIGHTY) times. WTF? I didn't answer the first 30 or so calls because I was driving to school, then in class. The last 50 calls I've just screened and not answered. At this point, I now have no intention of buying their cake or giving them any money for the extreme unprofessionalism they've displayed.
I have checked my voicemail. The owner has announced his intention to call me nonstop everyday until I pick up my cake.

The guy obviously has the drive to do (80 calls!) I'd go buy the cake, 80 calls would drive me ape sh*t clearing from my phone.

Go pick up the cake, it a custom made, and they did you a solid by not making you pay a deposit.
To me, as soon as you make a custom order on a food item, your kinda responsible for it.

custom as in your gfs name and what not or could it be re sold?
Either way, 80 calls is pretty impressive. Must not have any large orders today to work on.

--Cake is maybe $30-$40.
--It has a custom design, and a custom message "Happy Birthday [Girlfriend's Name]" that is usually written on a piece of white chocolate that is put on the cake.

Just pay for the cake.
I never custom order if I think I might have to cancel, as soon as the first ingrediant hits the kitchen counter there's no take backees.

How much time have you spent checking your phone? In your opinion has that amount of time equaled $40? If so, I think you are entitled to $$ from the cake baker. Seeing as you technically owe him compensation for the cake, and he owes you compensation for your time, call it even and move along.

I agree - Buy the cake and surprise your gf with it - tell her it's her birthday round 2. That way you score browny points and you don't dick around captain 80 calls.
Hopefully you get two rounds of something good too!

If they're a small shop and busy (as you said), it's not out of the question that they wouldn't be able to get to the phone to answer it and would have no idea you wanted to cancel the order. I can see why the owner would be mad, but you're not completely out to lunch either as you did make an effort to cancel the order and it's not your fault they didn't take the call.
Crappy situation, but I don't think it warrants disparaging this bakery online as the owner has a case for wanting you to pick up and pay for the cake you ordered. Hopefully he'll take deposits from now on to prevent this from happening again.

Get another gf with the same name and give it to her.
One time I passed out drunk after ordering a Pizza. They called that night and left a funny message even though I did not hear the phone.
I went in the next day to apoologize and pay for it, and leave a tip for their troubles, and they still had it on top of the oven. So I got the pizza after all.

I'll contribute $5 to the cause if you post a picture on CP. $10 if you can convince them to deface the cake with some kind of innuendo against the OP's GF.
As to the OP, pretty cheap move on your part. I don't think you can cancel a verbal contract by leaving a voicemail.
