No, it just shouldn't automatically exclude you from being able to consent to sex.

Well it doesn't, as seen in bars and clubs all the time.

Actually, if you're at a bar and the people there know you're drunk and know you're going to drive, THEY are responsible for what happens after allowing you to drive drunk.
Much the same, the guards are responsible for allowing this to happen on their watch.

No, I think it's only a private party and even that might not be true. Anyway, it's completely different as the guards are in a position of authority and should have acted.

No, you're absolutely incorrect. In order to be eligible to serve or sell alcohol in the province of Alberta, you need to be trained. Part of that training is understanding the responsibility you and the business you work for have in ensuring the persons you're serving are safe. If I overserve you and you drive drunk and get into an accident, me AND the company I work for can be held liable.

Proof? Even if it's legal, how would you prove liability?

Under the section "Liquor to intoxicated customers" it is illegal to serve to someone who is intoxicated. Servers have a duty of care to the customer.
Duty of care (in the context of liquor service)The requirement of a server or retailer to take reasonable care to avoid acts or omissions that could result in injury to a customer or innocent third-party and to take reasonable steps to protect a customer or innocent third party from foreseeable risk of injury. Frankly, it would be fairly easy for someone to prove liability; bars have people in them, liquor stores have people around, all it takes is one person to know that the person was in your establishment drinking... Driving drunk is a foreseeable risk of injury.

Thanks. I'd forgotten this, but of course you are right. I remember being on the board of a club in undergraduate and having to purchase extra insurance for having drinking events off campus.

Because you owe a duty of care under the law. You breached that duty when you knowingly over-served the patron. You wouldn't likely be 100% liable here but might get tagged with a small percentage. If the loss is severe though that small percentage might be a lot of cash.
The other point here is that this is a civil explanation, not criminal. The concept is called social host liability IIRC and could be apportioned to you if you are serving people in your home as well. The duty of care is stronger if you are running a professional establishment, but in either case it could be an issue. This is the reason a lot of businesses give taxi chits at office parties as well.

So remember that next time you think to tick off your usher or whatever... they can ALL kick you out.

Aaand there's the name drop.
How could you forget such important information?
Were you too busy philosophizing to remember the affairs of the board?
Seudo-Intellectual.

Anyone can be in a club in University. It's not some sort of important, name-dropping piece of information.
It's "pseudo."

No, no - the alleged intimacy lasted 1 hour; they allegedly watched for 7 minutes.

Perhaps it takes at least 6 minutes to certify that lesbian sex is occurring, and 1 minute to respond.
Is it illegal to get to second in jail?
