FYI, the Judge refused to grant a stay so as of August 18th at 5pm gay marriages will be able to be legally performed in California.

I think he stayed his decision at first on purpose, so they would have to bring it back to him and he could refuse to stay it for the duration of the appeal. Now, I would think it would be harder to get a temporary injunction from a different judge, which may not have been the case if the judge hadn't stayed his decision in the first place. Pretty cagey judge methinks...

The fact that gay marriage is still not recognized in the US is a national embarrassment IMO. However, recent polls indicate a majority of Americans now support gay marriage so it will probably be legal nationwide soon.

It's been a long hard journey but I finally feel we're near the climax. Gay marriage has definitely received a lot of stiff resistance however I think in the end we just need to grab the idea with both hands and just really work it. We can do it people. With a little bit of an open mind and some forward momentum we can really bring this big boy home. I'm convinced that America can come from behind and realize that accepting gay marriage is a huge step forward & that all the hostility just needs to be put behind us.

True. What is particularly infuriating is that nearly every poll on the subject shows that over 80% of Americans favor repeal yet the administration still finds itself unable to repeal it for some reason. Democrats are for the most part a bunch of gutless pansies; the most conservative 30% run this country.

Yeah, I don't get that one either.

Gay folks have been fighting and dying alongside straight folks for a long time now. The fact that they're supposed to shutup about their sexual orientation but can live in a fox hole with a bunch of guys for days on end is ridiculous.

If you don't want gay people serving in the military, than have the balls to say it. Otherwise quit with this half-assed 'I want to be politically correct' BS.

I'm a little surprised that the 9th circuit granted the stay, but I think we should be a bit cautious about the "liberal" and "conservative" labels here. All the courts are considering is whether Proposition 8 is consistent with the constitution, not whether gay marriage should or should not be allowed in principle.

You're right, this doesn't guarantee anything except that there won't be any marriages permitted until after the 9th Cir. has weighed in on the case, any further appeals will come about subsequent to that case.

The Supreme Court decides whether to take the case after the 9th Circuit's decision is appealed. IIRC they need 4 justices to agree to take the case. So they should have that from the 4 quasi-liberal Justices.

To rule to uphold Prop 8 would require a very narrow reading of the Due Process and Equal Protection clauses of the 14th amendment. Only the most ardent conservatives have that narrow a view of those clauses. Kennedy "the wildcard", is not one of those Judges. Which he proved in his majority opinion in Lawrence v. Texas. The 9th circuit upholding the lower court's ruling is almost a certainty. The Supreme Court will then in all likelihood uphold the 9th circuit's ruling. Or, at the very least, outline a civil union middle ground.
