Geez in my day if we accepted a soda with the lid half off and we spilled it on ourselves, we'd swear a couple of times and then mutter "That was f$$kin dumb" then drive off.
Nowadays its "Not my fault wahhhhh you should snivle pay for my stupidity"

I haven't eaten at McDonald's in 10 years, mostly because the food sucks, the other part is the service sucks.
That said, if you saw the lid wasn't on properly, and you still tried to take the cup and spilled it on yourself, sorry you don't have a case. If you didn't know, then maybe you have more of a case.
As Ken said, the phone shouldn't have been on your lap in the first place (mind you would it still have been wet if it was on your hip? Either way, you took the risk of spilling it when you saw the lid wasn't on all the way)
As for the post questioning why he even got a pop from McDonald's in the first place and not buy a flat from Costco. Last I checked (and I could be wrong as it has been a decade) drinks come with a Value Meal. So the 2 cents of syrup and water is already included. In addition, even if he didn't buy a value meal and needed a quick fix, for $1 it's quicker and easier than going into a corner store or gas station where you can get the bottled stuff (albeit better quality) but for twice the price.

I dunno, I still eat at MacDonalds once in awhile. Healthy? Definitely not, but it's sure damn tasty. It's my guilty pleasure. I guess I'm no food afficionado.

puckluck, don't listen to these guys they are just giving you a hard time. You totally have a case here. I'm not a lawyer but here is what I would consider doing:
- march into the store with a friend to video the exchange of you explaining this to the manger and demanding compensation. Post that here so that we can all help with your case.
- don't forget to use phrases such as "how hard is it to put a lid on properly" or "don't you people know how to do your job?!"
- remember that you have clearly been wronged. It makes total sense to have your blackberry on your crotch while in the drive-thru. That when someone calls or texts you feel the vibration instantly. It's the fact that this big faceless corporation failed to notice that has caused the damage here.
- if they can't secure their lids adequately then they should either serve their drinks in a can or not at all.
- above all, this is not your fault. That and the video so that we can best assist you in this tragic situation.
