Just thought of another angle; do you know any of the handicapped employees who pay for parking? Can you get one of them to start parking in that spot so she has to find another place to park?
I know a few people that are handicapped and get FREE parking because they followed the proper procedure but they don't start work until 9 and she starts at 7:30. All the offices dont open till 9 either so it isnt occupied by clients in the morning.

Building management knows about the issue. They have complained about it to city bylaw who is in charge of designating it handicapped not the building as the spot is located on the street.

Actually it does make it wrong. The intent of the spot is for clients to use temporarily. There is a process in place for EMPLOYEES to get special parking if they need accomidation.

Then you've honestly gone as far as you can or should legally. Is the spot labeled with a time limit. If not then there isn't anything you can really do. You can hope that some bylaw officer is sharp enough to notice that her car is there all the time.

My bad I misread....but still sounds like you've done all you can without putting yourself out there. I guess it matters how personal you make this matter.

Thems the breaks.

firstly, jolinar.....start spelling accommodation right.

Secondly, your best bet is asking her about it. If she has real problems (veins, nerves, etc etc) then you can back away. If she is milking it, she'll likely cave and stop parking there out of embarrassment.

Video tape her, type up a letter listing your concerns and alligations, as well as your fears in coming forward, don't sign the letter, then send the letter and the tape to all the local tv news stations.... and let them run with the ball.

Or she'll complain about you infringing on her privacy.

All she has to say is she has injury issues. No check that, all she has to say is you have no right to know about her medical problems.

You can politely ask her why she's using the free spot, but the only answer she's obligated to give is its non of your business.

I'm not supporting her in this case, but going after this could cause all kinds of problems for Jolinar especially if he works with her.

I doubt the media would do much. If they go after her and she actually has a legitimate issue, then George Lucas is going to get sued.

Even if they ask her about using the free space, she could either claim ignorance, or state that nobody told her that she couldn't use it.

As an alternative, you could also tape her, put it on youtube as a private video, then give her the link (email, or mail), and tell her you'll send it to local news and coworkers if she doesn't stop parking there.

**this is assuming she is actually parking there without handicap. Doing this to someone with a legit claim is pretty horrid.

There is no time limit. The bylaw people know she is there all the time. The city bus operators complain about her. They want to do something but they can't as the person who makes the decision on these spots doesnt seem to care that she is abusing it.

I understand there is nothing that really can be done ATM because she is technically not breaking any laws other than possibily fraudulently getting a handicap sticker. But like I said before, I don't care if she is handicapped no matter what the issue might be, but if she really is then go through the process like every other handicapped person and leave the spot open for people who need it temporarily.

Also, I just think that having an attitude of letting it be is a easy way out. Maybe it is the law enforcement side of me but when I see someone doing something wrong or not following the rules it makes me want to correct the issue. If we all had the attitude of just ignoring the issue there would be a lot more fraud going on that already happens.

I'm sure if it turned into a big enough issue, someone would be able to find out.

Has Jolinar ever gone on CP during work hours? Cause I know my work logs stuff like that frequently. Probably wouldn't be two hard to put two and two together....

Opps sorry about that. I know how annoying mis-spelt words can be.

As for talking to her, I really don't want to go there. She has told her own co-workers why she parks there and she says it is because of her knee.

But again even if she has other issues, that is fine, I hope she doesn't but if she does; all she needs to do is talk with her manager to get her an accommodation.

I still don't think this is any of your business jolinar.

You don't know she is doing anything wrong. To do what you are suggesting to somebody who is legitimately handicapped is dreadfully disgusting.

Fact is, to get the handicap sticker, a doctor had to sign off on it. A medical professional with much more expertise in this matter than you.
Fact is, it isn't a temporary spot. From what you have told us, there are no rules against parking there indefinitely.
Maybe her manager doesn't know the rules about underground parking or isn't willing to do the paperwork.
Maybe she doesn't know to ask her manager or doesn't want to, she already took time off work for surgery and recovery. A lot of handicapped people don't want to be anymore of a bother, and most workplaces are woefully unsympathetic.

As someone who's parents have both had knee surgery and who's mother uses a handicap sticker now, what you are doing right now is really abhorrent. Give her the benefit of the doubt. Stop. Please.

Yeah man.

For all you know she might have a loose uterus that could drop out if she has to walk more than a hundred yards.

Nobody wants to deal with that.

You miss the point. The point is that she is parking in a handicap spot that is specifically for the use of the general public (handicap public that is), not employees. Handicapped employees have access to handicap parking elsewhere. She is abusing the system.

By her parking there all day, legitimately handicapped customers, have no where to park.

No, I did not:

Jolinar said that bylaw can't enforce it because it isn't marked as a temporary spot.

The solution is for bylaw to change the marking to a temporary spot if this is the case but to send a video to the press? Wow. Imagine if you were her and saw that on the evening news.
