I talked with the by-law officer today and she was really friendly. The biggest question I had got answered and that was about mitigating the problem. I told her I would put up some insulation, put some pillows in the base drum, etc. etc. to dampen the sound. I asked her what the repercussion would be if it wasn't seen as "mitigitating enough" and she said honestly very little. The section 27(2) is very vague and completely subjective - apparently they hardly ever give out fines because honestly a neighbour could complain about their neighbour sneezing too loudly.
She said as long as I do what I can it should be fine because the onus is then on the neighbour to go to court or something. I told her that if a next time happens where they lodge a complaint to suggest them coming to speak with me about the issue...that I won't bite their head off and am a reasonable guy. She slipped up and said him so I don't know which neighbour it is, otherwise I'd go speak to them about it now.
Either way she was very friendly with me and assured me that if I put some effort into the situation it would be fine. And she said she'd come listen to me sometime...haha.

Nothing to contribute really, but thought this is kinda funny. I used to be neighbours with Bill Bruce, the head of Calgary By-Law, and his kid would play drums for hours at a time when he got home from school. You could hear it from inside our house, but nobody really cared. I guess he's lucky he didn't live beside some of the crotchety old fuddy-duddies here or he'd have been having staff parties at his house with all the noise complaints.

Glad to hear it worked out well for you man ... when I was reading people calling you unreasonable I couldn't help but laugh. Figured you'd do your part to straighten things out. If my kids ever want to play drums ... I'll have to factor soundproofing into the budget ... for my sanity.

The rights of your fist end at the tip of my nose. That is how I was taught the principle in school. It doesn't matter if you don't think it is a big deal, even though I respect your opinion. If the the other guy disagrees you will lose.
Look at it this way, the cost of those dampener things is less than a single ticket.
And to all the comments about just talking to the offending neighbor, I have been in this type of situation, tried to talk to the neighbors twice and they either ignored the concern or totally snapped on my wife. Who needs that? Call the people paid to deal with it. I can't believe that Cpt. Crunch was the voice of reason I agreed with.

No one ever complains around me. I drum hard, and really don't care when I play (going to right now). They're in the basement, but you can still hear them outside, definitely not through walls into other houses though.

Actually I'm a complainer type. But now that I see you you're making every effort to keep it down and be considerate, bang away. I can deal with it.
If you could find a guitarist and make some good music out of it, I would be even less bothered.
At least you're not one of those people blasting rap as off the front step.
You should let your neighbor know you are doing everything you can to keep it down. It will go a long way. If they don't care then you got a bad neighbor unless they have a baby or work nights.
