Ah, the rolling eyes emoticon... now I can see what a joke my argument is! Touche!
I guess the person just has to put up with the noise then... case closed. Glad I have the neighbours I do... I don't bother them, they don't bother me. How unreasonable.

Mowing the lawn is not nearly as loud as playing drums. That's like comparing a car going by on the road to an airplane that's close enough overhead to have its landing gear down.

Just curious, why do by-law officers hand out notices for drums, and not for mowing lawns?

alright, i am not going to wade into the hate here.
Simmer, you could put pillows in your toms to quiet those. Maybe tape something to the back of your cymbals to make them quieter.

They will, if you are performing yard work outside the allowable hours. I had a neighbour that used to like mowing at 10pm at night, that didn’t last too long.

Well that just seems to make sense. The comparison was really a 5pm one... I can't imagine by-law officers handing out a noise violation for mowing your lawn at 5pm, the same time the drums were being played.

I'm having a lot of trouble understanding a noise violation at 5pm, period.
If you expect quiet and solitude at that time of day, a large town or city is probably not where you should be living.

30 minutes at 5 PM should not constitute a noise violation. I stand by my opinion that the neighbour is being unreasonable.

The neighbour is just as bad as the drummer if he/she doesn't give an opportunity to work something out.

Yes the neighbour is a big, bad ol' meanie...
Sorry, but it isn't a constitutional right to have noisy toys.
Drummer guy has four choices.
1. Procure rehearsal space in a non-residential area.
2. Stop playing drums altogether.
3. Purchase sound-deadening pads
4. Pay the first of what might become a multiple number of escalating fines.
Now, option three sounds reasonable, no? Might be the cheapest option, but Drummer Guy by his own admission is trying to weasel out of that one.

Sounds good, I'll stand by mine that playing the drums at a level at which your neighbours can hear is 'being unreasonable', at any time of day. By-Law officers seem to agree.
If you're going to conduct a noisy practise in your garage, take the steps to mitigate noise levels. That's a 'compromise'.

He could also try playing in his house but apparently he doesn't want to annoy his family.

Maybe he just really sucks at the drums and his neighbor can't take no more?
Not so much the noise but the quality of the noise... I kid brother.
Got to admit this kinda sucks for you. A little lame that they just didn't approach you as 5pm sounds like a completely reasonable time to make some noise. And if it was not good for the neighbor you would think they would have no problem mentioning it to you. Hey bud, I am asleep at 5 pm any chance you can practice at another time?

Ok this is just a logic thing here in this debate, I don;t really have an opinion on either side. However, the above point kind of seems to poke a hole in the argument, no? I.e. I don't play inside b/c I don't want to bug the people inside ---> so I go play outside somewhat in my garage area ---> it bugs the neighbour (rightly or wrongly) ---> neighbour shouldn't complain, its really only for 30 min at 5pm, no big deal ---> yet I won't play in the house b/c it bugs people in the house...

THe only solution is to burn down every house in a 100m radius of your house. For sure, you'll get the culprit. Then once everyone is homeless, you can practise in peace!

Its 5pm. I would tell them to fata off. Or find out who did it and then complain to bylaw to them about anything and everything you can think of.
If you are doing it between 5pm and 530pm then those people who complained need a fricken life.
A great bylaw retaliation tool is if you live in an area where you need a parking permit, if they ever have friends over who dont have permits (unliekly as these snobs probably dont have any friends) call bylaw on their friends vehicle for parking violations.

And then the neighbour returns the favour by picking at every little thing too. No one wins and everyone is worse off.

What people are trying to say is that it's sad in society people can't handle simple disputes like adults. Most people are pretty reasonable in this day and age. If you work a night shift and need total quiet during the day, you probably shouldn't live in an apartment building or close quarters with others.
5pm is a perfectly reasonable time to make some noise. It's like the morons that live a block of 17th and then complain on the weekends/rare Flames playoff triumphs that people. You live a block away from the busiest street in town with the most bars. What were you expecting?
