Let me ask you all a question.

Who here has tried pot?

Who in their lifetime has had one puff?

Now, if you believe the police don't have to properly investigate or provide the ability for a full answer and defence for the OP, then merely admitting to trying pot means without any investigation you should be charged and convicted for the criminal usage of illegal drugs.

Admitting he had a drink is not enough, according to the definition of the crime, to prove his guilt. It is required the officer take a breath sample. Just as it's required that the crown provide sufficient evidence in order to convict beyond all reasonable doubt. Frankly (if what the OP is saying is accurate) I don't think that's been done here.

They must look at this differently than a standard DUI charge, as I have seen people in 5 figure territory for car insurance after DUI's. You know you were drinking, we know you were drinking, and you told the cop you were drinking. What are you proving by beating the system on a technicality? It takes a much bigger man to accept the consequences, than to weasel your way out of it.

Not that it probably means anything to you, but you would have my respect if you accept your punishment... As I had mentioned in PM's, 2 people close to me have been killed by drunk drivers, so you can likely understand my position.
I recall talking to an insurance agent that mentioned that something like a stunting charge is treated the same way as a DUI when it comes to insurance rates. That should be enough to keep anybody from doing it.

Well it looks like either the officer was giving you a break in only suspending your license or he is a complete idiot . . . actually he is a complete idiot either way. Looks like all the above are fact and there can be no charge without a test.

I hope this officer in question gives his head a shake and gets it right next time.

Stunting is a major conviction, DUI is criminal in they eyes of insurers. Not as bad but certainly not a good one to have on your record.

There's nothing I hate worse than the term "man up" being used in reference to fighting the law to get a reduction in an infraction.

Like c'mon, if a woman is getting assaulted and you're a guy who walks right by because you value your safety over saving someone, then I'm all for that person being told to "man up". Or in a hockey game when a guy does something cheap and gets challenged by another player than yes, that player should "man up".

There's many situations where the term "man up" is appropriate, but to call out someone's manlyhood because they want to exercise their right to challenge the legal system? Give me a break.

When I hear it/read it, in reference to fighting the legal system I see it more as bitter people who are mad that someone's using their precious tax dollars to use the legal system, so they want to throw out an insult to try and bring that person down and make them feel inferior.

It reminds me of that Russell Peters joke where he's explaining how the asian guy at the mall tells guys to "be a man" as a last resort when guys are walking away from his kiosk without buying something.
