Don't know how I lost this in the shuffle a few years ago.

It's from June 22, 2007 for $130.86, I've looked over it a few times and there seems to be nothing on there about it being expired. I'm hoping it can be cashed, seeing as the company does owe me those hours. Does anyone know what the deal is?

Its fine, just cash it. The only thing that can go wrong is if the account is either inactive or empty.

I thought cheques had a one year expiry on them?

Just found this on google. IT appears I could be alright, pending on how the bank wants to handle it.

A bank is under no obligation to a customer having a checking account to pay a check, other than a certified check, which is presented more than six months after its date, but it may charge its customer’s account for a payment made thereafter in good faith.

In other words: the bank isn’t required to pay a check more than six months old. But it can if it wants. The bottom line? If you have a stale check outstanding, contact your bank to determine their policy. Don’t just assume the funds are free to be spent."

Well yeah, but this is a paycheque, if the employer still has the account there and theres money in it then theres no problem, if they dont then the bank isnt going to fork out the cash.

So do you think the employer would still have the account? Do these things generally stay open? I'm assuming the bank can find out right away if the account has money or not and will go from there.

I had one returned to me once. After 6 months it is 'staledated'.

Yup. I used to work at TD and any cheque after 6 months is considered stale dated. The only way to get your cash back from your employer would be to have them reissue a new cheque. I think you are SOL.

The right thing to do would be to call the company. I don't think cheques stay valid forever.....

Having worked for a Charter bank (CIBC) I can tell you that cheques that are older than 6 months are "stale dated" and wont be negotiated.

I worked for a financial institution- they're no good 6 months after the date on the chq. HOWEVER, if you are owed the money by a company still existing, they should be able to re-print a chq for you, and have the record that the previous one was never cashed...

I also used to work at a bank (at a cheque processing centre, no less). Officially, it is stale dated, but that's if someone actually catches it. Put it in the bank machine and see what happens. I have seen cheques get processed that had no signature (yes - no signature), so the chance of the date being missed by human error is actually quite good. Unless the company specifically made a stop payment on it, it'll probably slip through without issue.

If you are going to try to "slip it through"- I would wait until about June 24th to do it. Less of a chance the date would be noticed.

However keep in mind that if the cheque is returned to you; your bank might charge you a fee for a returned cheque.

I also worked at a bank. It's stale dated.

Talk to your employer that cut you the cheque. They should have record of what went into and out of their account, and should see that the cheque never came out of their account. If they're honorable, they should re-issue a cheque for the same amount.

A paycheque is still a cheque. A cheque is just a piece of paper. Banks will look it over as much as possible to make sure they aren't at fault for any issue. Human error can happen, but I wouldn't hope for it.
