Question Another tint/speed tickets - go to court!

We are new in the city and have had an appointment with the doctor last Wednesday whose office is located in 4825 Dalhousie Dr NW. So I missed a turn from Shaganappi Trail and had to take a turn to that small plaza just right after the road, made a circle and took left at the Stop sign to Dalhouse dr. Right after the road has playground sign with set of lights within aprox 500 m. So you basically cant speed on the truck on that road even if you want to.

My wife with kids (2 y/o both) was driving behind me, because we want to drop off another vehicle for service after doctor`s appointment which we didn’t do it anyways. So when I took entrance to that plaza, he was behind me and several cars were in front of her, so she was not able to see where I was going to and what I was doing. Especially we were late for 20 mins, and kids were crying. Now you can imagine that she was under the high stress, especially she doesn’t drive too much at all. We stayed at the left line, because we were need to take left at the end of third light. After I passed the first set of lights I saw how a cop parked on the sidewalk running to the middle of the street and pulling her over when there were 2 more cars dring to the same direction as we do, one was behind my wife` truck and another black vehicle was speeding on the right side and passing my wife`s truck. So the cop pulled he over and because she didn’t have registration (it was in my wallet) I have to make u-turn and come back in 2 mins, so I pulled over to the side walk in front of her car. Cop came to me and asked if I have registration for the truck and also he asked my DL and registration as well.

When I was giving him all our papers he just briefly asked if I am aware that both my cars have tinted windows. So I said I know that. After 3 mins my wife called me and asked to ask a cop if I can go with the baby by walk to the doctor`s office which was just in 100m away from us, because baby was felling sick and we are late. I came to his car and he said just wait for a sec and he would be done with us. Right after he came and gave us tickets: me for the tint (72 (3) - $57) and to her for speeding (115 (2) (p) - $166 at the playground checked with the laser gun) and the tint (as well). End of story.

Speeding ticket based on his written info – she was driving 58 instead of 30.

As I know speeding would be really hard to beat especially for playground, even if we will assume she was speeding. However truck has Bell Stealth radar and it did come up just when the cop was running to the middle of the street for few secs. Therefore he might pick somebody else’s speed from the car which was on the right line which passed them quickly. Anyways it would be hard to prove meanwhile we don’t have any evidence to show it.

The point is about the tint. He did not use any equipment whatsoever to check windows, it was only his gessings. Therefore this would be easy to beat in the court which I am going to do. Especially vehicle which I was driving was with no Alberta’s plates and I showed him no Alberta DL as well.

What you guys think about chances to win a case about the tint and speed?

On the speeding, next to 0 unless you can prove that they picked up another speeding car instead of your's.

On the tinting, probably not a good chance especially if you have any kind of tinting on your windows. Its not the degree of tinting, its the fact that there's tinting at all.

But it doesn't hurt to try to negotiate the fines and demerits for the speeding ticket down if you can.

I don't think he has to use any equipment to check your windows, as any kind of tint on the front windows is technically illegal.

Agreed about the speeding, however if you dont try it you wont win it.. I am doing a research about all of this issues right now and just dont really catch why all of thise tickets (yellow form part 3) dont have model, plates, dr info...... just name and address ?

Any film on the front window is illegal in Alberta. And how you got a $57 tint ticket i'll never know. When I got my tint ticket the cop said to me that he used to give out warnings, but saw that no one actually took the tint off, and I didn't look like someone who would take the tint off so he gave me the biggest fine he could. I think it was in the $180 range. I should look that up to see if I have a copy of it.

If he didnt fill out the ticket correctly it will get tossed. The only time I've seen an error on a ticket was when my buddy was 17 and the cop checked the adult box. He was able to get it voided for that reason alone.

A couple years ago I got a photo radar ticket on elbow drive in one of those non-playground playground zones. I paid the ticket and a couple weeks later they sent me a check in the mail for the ticket because apparently it had been filled out incorrectly. Everything went better than expected...for me. My friend that was following me also got a ticket and did not get a refund.

If they got your name correct then they can still track you down. Odds are they entered the license info into the computer, and would be easy for them to find.

As for getting it tossed based on that- I have seen a ticket tossed because the postal code was wrong, and I have seen the ticket stay with the date being wrong. (Guy brought in a plane ticket to show he wasn't in town that date- judge said "that's why it says 'on or about.'")

I once got out of a ticket because the cop didn't put in 08 after the 20 for the year. I think he screwed it up on purpose because he started filling it out before he spoke with me, and I of course was so incredibly nice to him (which tends to get me out of tickets more often than not).

If you go in to talk to the crown they will reduce the fine and maybe if they are feeling generous toss it out. I have had both cases happen.

No offense to the original poster, but CSI and the like have given the average Joe an erroneous sense of the kind of evidence that is required to secure a conviction against them in court.

I'm not sure it matters if they made a mistake on the ticket or left something off. My friend had a ticket that had his license listed incorrectly and all they did was re-write him the ticket that he had to pay. So don't assume that because there is a mistake that it automatically means its void...

He would have been using a laser, so it's not surprising your detector didn't go off when he got her. They aim those at your headlight/bumper usually, so he'd know which car he picked off.

The tint tickets are a bit of a kick in the nards, as lots of people are running around in this city with tinted fronts. I've been pulled over a few times with tinted front windows and never ticketed.

I got a tinted window ticket once.
Of course it was a $28 ticket in lieu of a $100+ speeding ticket so I didn't complain.

That's all I have to contribute.

1) This is YOUR copy of the ticket. The copies he keeps and sends to court contains all the other information. You don't need to know your DL number or make and model of your car. It is also is tracked with your MVID number located under the bar code. That is how they connect it to the registries and force you to pay tickets when you register your car or renew your DL.

2) Trust me, your laser detector doesn't work.

3) There is truly no way to target another vehicle. Imagine pointing a laser sight through a scope. It can pin point a target with great accuracy.

4) There is no need to measure the degree of tint. His testimony is good enough. Plus, you just posted on a public forum admitting you have tint. In addition you posted a ticket with the cops regimental and name. If he is made aware of this thread, you are doomed.

Oops!

You're screwed.

For anyone reading this, always play stupid. I have been let off with at least five warnings for my tint by just saying "Oh, I had no idea. No one has ever mentioned that before."

Also, probably don't want to post this on a public message board if you plan on fighting it.

In Alberta, front windows are not allowed to be tinted while the back windows can be tinted as much as you want provided there are 2 outside rear view mirrors.

If you have window tint in the front, there is absolutely no way to get out of it.

My detector detects laser but by the time it does its too late anyways.

OP I think you are going to have to pay it and I would take down the pic or blurr out the cops name and reg number but thats just me.

And thats how everyone's ticket looks.

But you are right. It will work IF this laser hits it, but by that time, its too late.
