While reading through this thread, the Pink Ribbon campaign for breast cancer came to mind. There is another organization that has a copyrighted symbol and has a totally different approach to managing and merchandising their symbol. I'm pretty sure they'd sue you too if you tried to make pink ribbon cookies. The difference with the Pink Ribbon people is that they totally sell out their symbol to any company who is willing to pay. I've seen dozens and dozens of products being sold in stores now with the pink ribbon symbol including, sadly, pink toilet paper. I think I like the Veteran's approach better.

You can't claim intellectual property on a flower. If you could, everyone would be claiming copyright on pumpkins, roses, daisies, etc. If someone created a towing company called Poppy towing company, there would be nothing wrong with that.
What's at odds here though, is someone using the same symbol as a tribute to a war veteran. And that's when it crosses the line from being just a flower into being a trademark.
Think about it from a hockey standpoint. If someone started a towing company called "Fire C" towing company, with a flaming C for a logo, it would probably be fine, so long as it didn't look similar to the Calgary Flames logo. But if you were to start a pro hockey team called the Flaming C's, or if you were going to sell hockey equipment with that name, then you're probably NOT going to be ok.
The cookies dude no doubt had good intentions, but in my opinion, he violated a trademark in a similar industry, in this case, having to do with remembrance of war veterans.
If he had just sold the cookies as poppy cookies, the Legion couldn't do $#!+. But as of now, the Legion have a very winnable case if it goes to court.

The breast cancer-specific packaging is more an indication of savvy marketing than corporate benevolence. Breast cancer is a disease. Not a marketing opportunity. In some cases, there's no guarantee at all that part of your purchase price will go to a charity; a generous estimate is less than 5% of ALL monies raised actuually go to prevention including research.
Exploiting a devastating disease in order to reap greater profits — while pretending it's all about funding research, at least until you're directly questioned about the fine print — may be legal and may even be "good business," but man, is it ever Slimey.
The PINK RiBBON is an AWARENESS ribbon , that's all.

I just played a game of golf with a vet and he was wearing his poppy on his hat the whole round.
He told me "In today's selfish world we should just be happy people are wearing them." and I asked him what he thought about me having a poppy up all year on my visor and his words were "That's great!".

Good. I always stick my poppy in my visor and it remains there until some windy summer day when I've got my windows open and I'm driving fast.

I never wear a poppy come November 11th. Instead, I support the troops by constantly lobbying for improved benefits and body armour for troops deployed overseas. I think it is very disingenuous to throw a poppy on your lapel for one week out of the year and consider yourself a patriot. If you really cared, you'd lobby your elected politicians to provide tax payer funding to support these people. Look at how many homeless veterans there are out there. It is a disgrace that in a country as rich as Canada that we have this problem.

Obviously you're just full of crap about lobbying for veterans rights. Explain how you do this lobbying. Write letters, go on a hunger strike? Or just make up stuff on the internet to sound like a righteous do gooder? Who is little more than an idealistic flake..

No, I don't do any of that nor did I try to say that I do. Only political candidates that support extensions of benefits for our veterans are considered when I step into the ballot box. This form of political activism does a hell of a lot more good than chipping off $1 a year into a poppy box and considering myself a good little Canadian boy for wearing a flower on my lapel.

2005 was the "year of the veteran", and on our uniform we wore a "year of the veteran pin" which had a poppy on it. So essentially we work a poppy for all of 2005. I've still got mine.
