Exactly why I agree with it.
Public is better protected by this decision.

Well if you do it for this guy you open up the whole euthenasia debate. Not that I'm against that either, but can't really just make exceptions.

A prison term might serve the family of the victim who are undoubtedly in pain.
But there's no rehabilitation chances in a prison sentence for this character who is severely mentally ill.
At least in a mental hospital, he'll get treated, he won't be dealing with the worst of the worst, and he probably won't get out.

Totally agree.
In my mind, prison is about punishment and rehabilitation. It's pretty clear to me that this guy is completely coo-koo. Prison wont change that. Now, if the guy did this because the other guy stole his wallet, prison might be the place for him. But an unprovoked act like this is the kind of thing that sends you to the psych ward for life.

take him outside and shoot him. Screw the hospital idea..what a huge waste of money, a single bullet doesn't cost much.

Why waste 100's of thousands of dollars on someone who is never going to get better?

I was hoping that Gimp just forgot the green font and was giving him the benefit of the doubt.
I find a sane person wanting to kill the insane far, far more depressing than the reverse.

To tradegy of this all is that the suspect didn't do the honorable thing and kill himself after the incident.

If the guy is mentally unfit they CANNOT send him to jail. The judge may want too. He may really really want to see him rot in prison but he can't. Even if he sentenced him to life in prison it would get overturned SO FAST we'd get burns from it blowing by.
Edit- And what Troutman said.

And thats why I have little faith in the justice system. Somehow this guy was allowed to roam around freely as he chooses prior to the murder.
If he cant be found mentally fit to go to jail then how is allowed free access to society?? Do we need to have a mental competency/fitness test for anyone over 18 to be in a "free" society??
He is absolutely criminally responsible and needs to pay for the crime. I have a very tough time believing any amount of rehab/treatment is going to help this guy.
