Default Auctions are going to be busy in Alberta soon (bill 50)

just saw this on yahoo, couldnt find it on here at all. Pretty bold step by the government.

Quote:
Passed by the Alberta legislature on Tuesday, Bill 50 amends the existing rules to allow courts to seize and auction property connected to crime.

That's crime, as in any crime -- and that's what has the teeth of this particular law jutting out like the fangs of a sabre-tooth tiger

crazy that you coud have a friends car seized and sold if caught driving drunk in it.

The part that makes me uncomfortable is
Quote:
Tested to the highest courts in other provinces, the law allows property to be sold off without a conviction, as long as the court rules it is connected to a crime.
So you could eventually be found innocent, but your property would still have been auctioned? I think that is BS.

Interesting... I get the point, but I don't really see why seizure of a car used in drunk driving has anything to do with the actual crime. However, if it means a bigger deterrent against drunk driving, I'm all for it.

Whoa, without a conviction is outright authoritarian. This comes with a sort of built in assumption that everything belongs to the State. Don't like it at all.

Good idea in principle, but there's some very dangerous implications. What happens if someone is charged and found innocent? Does the government say, "oops, sorry", or are they liable to pay back the loss, plus damages?

What happened to innocent until proven guilty? I could see seizure upon a decision or plea of guilty... but to be able to do it without a conviction is very disconcerting and very authoritarian.

It'll be interesting to see how this gets handled.
I'd imagine that it'll be used more for cases of drug and gang related crime (I didn't read this article, but I read one in the paper this morning and that's what they said as well) and not so much for things like drunk driving unless it is a repeat offender or something like that.

On a side note, isn't there already a law that says that the police can seize your car if you're using it to troll for hookers?

So if you get busted for pimpin, do they put your girls up for auction?

I mean they are your property and all.
