Never heard of random BA's being done before. How are they administered?

I second this advice. This is a fantastic plan.

-About 700 bucks in court costs
-Level II alcohol classes (24 hours) about 300 bucks total
-MADD Panel (2 hours) 25 bucks
-Community Service (24 hours)
-Random BA's twice a week (dropped to one a week next month as long as I keep passing them)

And that's about it. First time offender with no prior criminal record. Costs me 50 bucks a month for "probation" costs, the BA's are 25 bucks a month. I will be off of Probation in February (6 months early) as long as I don't get arrested or fail a BA, which shouldn't be too tough. Not a cheap experience, and not one that I plan on ever repeating. I won't even chance having 1 beer and driving now, let alone driving drunk.

Can you still drive or how long were you unable to drive after you were pulled over?

and DWAI 's are not criminal, just violations right? So no criminal record?

To answer the questions. For the random BA's, I am assigned a colour. The place I did my alcohol classes through has a phone #, you call daily and see if they say your colour. If it comes up, you have til 5pm to go in and do a BA.

As for driving, the DWAI part of it is totally separate from the DMV. I had that hearing a while back. I went 1 month without a license, and now I am on a red license for 5 months. Red license = allowed to drive to work, get groceries, pick up daughter. Not allowed to drive for any other reason. If I get pulled over and can't prove I am doing one of those things, license gone for a year.

And to be honest I didn't even ask about the DWAI thing being criminal record, I was just trying to get the hell out of there. Suppose I ought to ask my lawyer.

Edit: Btw, I did buy a breathalyzer now, partly just to test these things. 2 beers in an hour is enough to have you above the legal limit and get you a DUI. So pretty much anyone who has ever had a few drinks with dinner and driven home has broken the law, just not been caught.

C'mon man...This was in his post that you responded to..."and not one that I plan on ever repeating. I won't even chance having 1 beer and driving now, let alone driving drunk."

It remids me of Office Space, when that guy keeps saying he'll do his TPS report correctly next time, and then each of his bosses repsonds by telling to make sure he does it right next time.

He did his time and obviously learned from it, so good on him. No need for the CP righteous bashdown to continue.

It depends on a lot of factors. For some people one drink in an hour is enough to put them over the limit. This guy I used to work with would only have three or four drinks over the whole night and be completely smashed. Even after one drink his face would turn red and he'd look drunk.

Out of curiosity - where did you buy it and how much? Would be fun when we go out drinking.

Interestingly enough he probably isn't over the legal limit even though he is completely smashed. The linkage between BAC and level of impairment is non-linear and different for everyone.

Based on past threads of similar topics that thread would be filled with the most smug, self-righteous posts in the history of CP.

Posters would flock to the thread to see who could come up with more disgust for anyone who has been within 1,000 km of a drink and then driven afterwards.

I certainly don't support drinking and drving but the fervor that comes up about it when people are talking about it abstractly (as opposed to when they have had a drink and driven home) is terrible.

It would be interesting to see the actual results but whether consciously or unconsciously I doubt we would see much more than many here showing that they haven't come close at all or even thought about thinking about driving home when they have come close to drinking alcohol.

If you had a poll you would need Catagories with lots of choices to beat the smugness out of people starting with

If you have had 1 drink and driven the same day as the sedative effects of alcohol can affect someone for up to 12 hours (not that they are impairing). So my poll would be:

I have never driven while impaired
I have driven while tired
I have driven while talking/texting on a cell phone
I have driven within 12 hours of having 1 drink
I have driven within 2 hours of having 1 drink
I have driven within 1 hour of having 1 drink
I have driven after drinking 1 beer per hour I have been out
I have had 3 drinks and driven home
I have had 4 drinks and driven home
I have had 5 drinks and driven home
I regularly Dirve after having 3 drinks
I regularly Drive after having 4 drinks
I regularly Drive after having 5 drinks
I regulary Drive after having 6 or more drinks

It is just like noone on CP speeds or lets their dog off its leash in an area that is not marked as an off leash area.

Ironic isnt it? Angels throwing stones? I would have thought that would be mutually exclusive...
