Whenever we have things in society that are egalitarian but at the same time potentially dangerous the rules tend to be of a Lowest-Common demominator variety. IE look at our speeding threads. However that being said it's a dangerous mindset for people to just assume that they fall far above what is considered 'Lowest Common Denominator."

On the other side of that argument, it's also possible to blow below 0.08 but still be charged with impaired driving.

Look we can pile on, and its open game on that, theres nothing dumber then someone who gets into a car after drinking, and its even dumber to take that chance because you think you feel ok, basically you can't self measure yourself, and since booze impairs your decision making process, your in no position to decide if your ok. Why take a chance, a cab is cheap.
But the poster is due to fair due process and should get every benefit of the system. Make sure you contact a lawyer, maybe they can plea it down if you need to drive for work and they can put the test device in your car and allow you to drive for the purposes of work. If theres a financial issue with any fine, I believe that a judge might be sympathetic if its a first offense.
The important thing here is that you learn your lesson and don't do it again, because getting caught a second time . . . bad.

Thats a good point. I know a lot of people who wont drive after two beers at a night out and for me there is no way i'm remotely intoxicated at that point. However it doesn't mean that you can still safely operate a vehicle just because you are under .08 either. There are many people who can't drive worth a damn when they are sober let alone after one or two beers.

The ease of getting a drivers license is another discussion for another time though, as is the people who stop in the merge lane in front of me who should be culled...
Learn from your mistakes and make sure to get a lawyer. That is a must. Plea down if you can, don't just go plead guilty because you feel dumb. If this is your first offense you should be able to get a lesser charge that won't hang around for the rest of your life and affect chances of getting into other countries.

To reply to an earlier post, not sure what happened to the girl. I'm assuming she walked home. We were about a block from her place. I've been a bit preoccupied with getting a lawyer today, haven't given her a call. I got arrested and hauled off to the holding cell, where when I was asked if someone sober would pick me up. Called up the ex and she came to get me.
Of course to get her rib in, first question was "was she worth it?"
Please continue on with the righteous anger.

If I got a DUI my WIFE (notice not EX) wouldnt even come pick me up, she would let me stay there until sober, then walk my sorry arse home.

I agree with the guys/girls that say quit pileing on. It sounds like he knows it was wrong so leave him alone. Maybe he could post how crappy the experience of no licence is every now and again and all the legal costs it will cost him so that other readers / posters on here may be deterred from drinking and driving. Obviously the commercials on tv and knowing its wrong aren't working, maybe seeing how crappy it is to live after getting caught will help.

I always felt that as part of a bar's liquor licence, they should have to provide a working brethalizer that customers can blow in for free. I have no idea, really, what .08 feels like. Everyone just takes a guess. I know of times when I have been clearly over, but I don't know if the one drink/hour I learned in drivers ed really is okay.
I wonder how many people would choose to drive knowing they were over .08. I bet there are many who get behind the wheel feeling they are less than .08, and then find out in a horrible way that they weren't.

I've had a couple encounters with breathalizers (never while driving) and I can say with certainty that 0.08 is drunk for this 220lb male. Maybe it's just me....

This made me laugh, but there was one part that annoyed me. And I just have to pick it apart. If you were a diabetic, urinating isn't going to lower your blood sugar level, that sugar's already in your blood and sitting in your urine. Peeing it out ain't gonna make a difference.
And there is really nothing else left to say about/to the OP. He's been piled on more than enough, so I'll just hold my piece.

My view is there should be a lifetime drinking prohibition. In this day and age with all the advertising it shows that you are not able to make rational decisions associated with alcohol. As such the privelege of drinking alcohol, arbitrarily earned by you attaining your 21st birthday should now be revoked from you.
In addition, there should be a mandatory driving prohibition and reeducation requirement to remind you that you can not treat driving lightly, it is a serious responsibility.
I'm glad that you didn't make excuses, but the consequences of your decision still need to be addressed. If you can not plan your consumption of alcohol in a manner that does not result in you violating the law, you should not be permitted to consume alcohol. Next time you drink, it might be me or my family sharing the road with you and I won't put up with that.
