It really pisses me off that the Police hardly ever get involved with scams. A scammer is just as bad as a child molestor and people who litter.

Why should scammers be treated any different than thiefs? The construction industry is filled with people who are scam artists and never have to answer to the police for their crimes. Steal a fridge from the same house that just got ripped off $5,000 from a shady contractor and you will end up in jail, while the guy that just stole $5,000 will only end up in Civil Court.

Crazy world we live in.

The RCMP has received a complaint and is weighing the evidence before deciding whether to launch a criminal investigation, said Staff Sgt. Dale Glydon of the commercial crime section in Calgary.

Court documents obtained by the Herald allege 14 business groups -- in some cases assisted by BMO employees -- set up the so-called straw buyer frauds.

Lawyer Michael Bondar, who is named as the lawyer on record for 52 mortgages, said he hadn't seen the paperwork either.

Also named in the lawsuit are four BMO employees who worked at the Shawnessy, Chinook and Brentwood branches in Calgary.

During question period, according to CBC radio, the gov't responded that the accusations against the MP "are a civil matter and not an issue of concern (to the gov't)" or something of the sorts.

It sounds like the lawyers named are not accused of fraud, but of negligence. In other words, they were not actively part of the scheme, but may not have done enough to protect BMO.

The important thing for BMO is lawyers have negligence insurance.

There must be some onus on BMO too, in not appraising these properties?

Anyway, from what I have been reading most of the lawyers named are not being accused of being complicit in the fraud, but rather negligent in not reporting indicia of fraud that BMO feels they should have been aware of. So potentially more an indictment of competency rather than ethics.

Seeing some of the names on the list, it doesn't necessarily shock me. I wish I could tell my law school story about one of the named parties, but it might get someone else in trouble (who really shouldn't get in trouble because it was an accident we even found out) so I can't. Let's just say, for one of these Defendants, this isn't even the first time they've been implicated in a series of questionable dealings and had their competency scathingly questioned.

I have it on good authority that the RCMP has been investigating several of the named Defendants for several months already and a number have long since been interviewed by the RCMP.

Some were principals and lawyers behind at least one of the failed high-rise condo projects downtown.
