Noted by someone earlier, but 4th degree is touching, 3rd degree is penetration. So I’m guessing the simple reason is that he didn’t cross the line required to take it from one to the other.
Absolutely gross and deserving of jail time regardless.

They like to categorize stuff in the US to a great extent. There's also 4th degree assault in a lot of places. In some places they have degrees of theft, including 4th.

Based on a quick glance at a Canucks forum, stories say "he'd hit on anything with a skirt" even after he got married, and that he always had "issues with boundaries" and that he had "a reputation" of hitting on other people's girlfriends.
