RCMP investigates based on recommendations given to them, eventually they decide to file charges, but that could be years down the line. In the meantime we have sitting MPs who may potentially be foreign agents which is a grave concern. MPs don't have immunity (which is why NSICOP members are unable to divulge the names despite knowing them as they can be prosecuted).
There has been precedent though this was prior to the constitution.
