True but there is also mitigation of damages by employees finding a new job while waiting to sue
If you can sit around for a year and not work you will most likely win and get punative too
However if you have all you old buddies messaging you to join FB as an engineer and work on threads and you take the role you’ve mitigated your loses and that can be taken into account on severance owed
That’s why a lot of people just take a full release and lump sum so they can get a job immediately and not pay back severance / self mitigate
