I guess, by the letter of the law, that's true. Generally if you don't actually connect, they don't call it.
I'm not really opposed to the NHL setting a new standard for suspensions where the intent is more important than the outcome. I think suspending to the injury causes some pretty bad incentives. That being said, if they're going to do that it should probably be as a result of GM meetings and should be implemented at the beginning of a season with a bunch of education for all the teams. Not suddenly handed down in mid-February.
