I just kind of assumed that they would have photographed his tattoos when he came in to the prison but likely not in that much detail. I don't think anyone could claim that this show aims for realism but that to me is part of its appeal. It's fun, and like Grant said, I think its a good thing that the conspiracy angle can (hopefully) go to the back burner for now and focus on the pursuit.
