It's not like she just got drunk one night and everyone wigged out on her. It wasn't a blood/alcohol test they went off of, it was a liver test. It's not about being drunk that night, it's about her liver showing damage caused by a history of alcohol abuse.

Are you not allowed to be a drunk, but only drive sober? Without proof of her driving drunk I can't see how this can be anything but a thought crime rather than a real crime. Also the article explains how it was only a blood test, no definiative condition was diagnosed.
