Pretty simple fix, if you ask me (who knows nothing of coding or programming) would be to restrict movement speeds to like 10-15km/HR. Since your phone is tracked by GPS, speed calculations aren't an issue. If your phone is moving faster than 15km/hr, the app automatically locks you out.
I understand people in the passenger seat would be affected, but is better to exclude passengers than to include drivers. IMO.
From what I understand that is how it works. I think it is 5mph limit.

My wife plays both of ours while I drive. Often at 80-100km/hr. Pokemon still appear, albeit they disappear quite quickly, and we can still hit Pokestops and gyms, though the latter is tough as you get out of range quickly.

If the police were smart… They would be sitting by some of these popular poke-stops and pulling over distracted drivers one after another. When I'm out with my kids playing this [on foot] it seems that every third car is swerving and pausing at every playground.

I completely agree.
I have a pokestop in a playground right by my house, over the last 3 days I see people with their heads down looking at their phones only to stop abruptly hop out and run to the statue.
This is a kids park and i don't want to come across as a bleeding heart what about the children individual but seriously..........what about the children?
And you know what, I see you are in McKenzie Towne so I am pretty sure you know exactly what park I'm talking about in Prestwick.

Haha, frankly it could be any of them ;-) It's crazy especially at the front of the Catholic church as there is a double stop there (and of course these are all in playground zones so the fines would be extremely costly).

I decided to give this a try. Downloaded it last night and used it on my 2km walk to work this morning.
Found one pokemon on the way and 2 pokestops (which got me some extra pokeballs).
I also used an incense once I got to work to attract some pokemons to me. Incense lasts 30 minutes and attracted a grand total of ZERO pokemon.
Am I doing something wrong? It seems like this would work a lot better in a more populated area (I am in Quarry Park).
Was your application on the entire time at work while the incense was going? The game will not track anything unless it's in the foreground.
Also ideally with Incenses you use them while moving as that will dramatically increase the amount of pokemon you should find from staying still (around 7) to much more (have heard of around 20).
