Default Weinstein Trial underway

Testimony started today in New York.

I think that the real problem could come down to credibility of the witnesses.

Isn't that pretty much the biggest problem when trying sexual assault cases in our judicial systems? They're effectively "he said/she said" battles, typically with very little evidence to support positive claims of wrongdoing, making credibility and testimony of victims and any witnesses paramount to getting any kind of a conviction.

The Jian Ghomeshi / Lucy DeCoutere case was a textbook example of this; the accused doesn't have to testify -- 'prove I did anything wrong', and the moment that possible collusion was discovered between the plaintiffs, the case was sunk right then and there.

Yeah, it comes down to he said she said. Questions like "Why didn't you go to the police etc" will play into it. Weinsteins lawyers are going to use emails and letters from the victims after the fact as a key argument that this is a case about woman scorned.

I read "Catch & Kill" over Christmas, which is Ronan Farrow's book based on his reporting of the Weinstein allegations. He goes into great detail of how meticulous he had to be and how many sources he worked with. He also describes the lengths Weinstein and his lawyers went to to try and kill the story. Given the expense of those efforts and the numerous NDAs Weinstein had with his accusers that he bought off, I am convinced the dude is a complete slimeball who figured he had enough money and power to never have to answer for his behavior.

Decent book and pretty quick read.

interesting how harvey seemed to suddenly need a walker as the court date drew closer. i am wondering if he will be wheeled in to the court room in an iron lung over the next three weeks.

hopefully the jury sees that there are enough accusers to see that this guy is a predator.

They're hedging their bets, if he's found guilty his "health" will dictate where he serves his sentence or even if he serves a sentence.

It will clearly be difficult for the jury to decide if incredibly sexy 20 something girls who could have casual sex with pretty much anyone they wanted choose to have sex with a corpulently overweight balding pock marked middle aged film producer.

I think his only defence is that economiclly blackmailing women into having sex with him wasn't rape, its the old 'I'm a ######bag that doesn't care about a woman's consent to sex but I'm not a rapist' defense.

Look don't put me on Weinstein's side on this at all. I believe he's an evil rapist.


However I think it becomes a lot more complex then you're thinking in the case of beyond reasonable doubt.


While AS probably made some emotion points, his defense lawyers were asking the right questions, why didn't you call the police, submit to a medical exam etc.


At the same time they have emails from victims long after the act saying "I love you big guy, I don't like feeling like a late night booty call"


In the case of he said she said, what she said has to paint a picture at the level of reasonable doubt. The jury can't make assumptions at all, and if they do it just opens up things for mistrials or appeals.


The jury can't look at him and go I can't believe a pock marked balding successful film producer would ever get a girl like that.just like you get can't get jury members that will think, that woman saw a man in a position of power to accelerate her career and he was wealthy as hell so of course she slept with him and then accused him of rape when he dumped her.


Your argument goes both ways.

They've picked two victim's, an employee and one unnamed, clearly the most aggregious, it his word against theirs at that point and he does not cut a sympathetic figure, he's not even arguing the sex didn't happen, just that they consented.

I suspect he will be sharing a cell with Cosby

I'd suck Harvey Weinstein's dick right now if I could parlay it into an easy job that pays millions of dollars.

I'd find being drugged and raped by Bill Cosby to be most unpleasant.

Although I do think Weinstein raped many people and was indeed a predator. Part of why he felt he could get away with what he did was that so many other women were not only into him but actively pursued him. I think you vastly underestimate the effect of the power he had. And no I don't believe all women are victims who need defending from men. While there were many victims here, must certainly many women were not.

Your angle of attack would be disastrous for the prosecution here, and lead to shaming of the victims.
