The two Republican board members in Cochise County, Arizona have decided not to certify their election out of protest.

They do not contend that Cochise County had fraud, indeed Cochise went hard for Republicans accross the board: Masters won 54-42%, Lake won 58-40%, and, crucially, in House District 6, Republican Juan Ciscomani beat Democrat Kirsten Engel 67-31%, or by almost 14,000 votes.

If Cochise County does not certify its election, by Arizona law, its ballots are discarded. This will not impact the elections of Hobbs or Kelly, merely will increase their margin of victory, however Ciscomani only beat Engel by about 3000 votes. If Cochise County's ballots are discared, then that seat flips from Republican to Democrat.

Quote:
If the board has still refused to certify by the Dec. 5 deadline for state certification (which can be extended to Dec. 8, but no later), the law requires that the secretary of state still move ahead with the statewide canvass of results. In that case, the statewide canvass would not include the results from Cochise County, which is heavily Republican.

This mass disenfranchisement of Cochise County voters − at the hands of their own board of supervisors − could result in flipping the final results in a number of tight races, with Republican candidates and voters paying the price. For example, Republican Juan Ciscomani would likely lose his congressional race to Democrat Kirsten Engel.
Were Hobbs a pure creature of the Party, she could choose not to apply pressure to the board members, which would benefit the Democrats, however as secretary of state it is her obligation to sue these people as:

Quote:
The law gives the board of supervisors no authority or discretion whatsoever to refuse this mandate. In fact, Arizona law plainly states that the supervisors board “has a non-discretionary duty to canvass the returns as provided by the County Recorder or other officer in charge of elections and has no authority to change vote totals or reject the election results.” And a refusal to comply can even expose members of the board to criminal liability.
Of course, ardent conservatives are up-in-arms that Hobbs would sue as this is somehow a conflict of interest, since she won the Governor's race in this "fradulent" election.

I think he is in a tough spot regardless of what his opinion is on the matter and needs to be flexible. Given the current state of supply chains, the energy crisis, inflation and everything else that is happening with Christmas around the corner, you 100% can not have a labour strike with railroad workers. It can't happen. Almost every single item we use in our general economy comes via rail.

Enough people would be against a railroad strike and shutdown that it would have ripple effects across the board.

It seems perfectly reasonable for Bided to limit the leverage the union have for providing an essential service. It's a pretty simpleton take to say forcing a settlement is anti-working class. The working class is only going to have but so much support for striking railroad workers who are turning down a raise that will give them an average salary of $110k plus strong pension benefits, when it is impacting millions of others lives and jobs.

I don't think pay is the issue:

Quote:
The September agreement added three unpaid days off a year for engineers and conductors to tend to medical appointments as long as they scheduled them at least 30 days in advance. The railroads also promised in September not to penalize workers who are hospitalized and to negotiate further with the unions after the contract is approved about improving the regular scheduling of days off.
How generous. Some of the workers can now get an unpaid day off with 30 days notice (assuming their medical issue can wait that long) and they won't be penalized for ending up in the hospital.

There's no reason the cooling off period couldn't just be extended while negotiations continue. They don't have to legislate a terrible deal that still offers zero paid sick days. And if they do want to legislate a deal, why not give the workers come of the extremely modest paid sick leave protections they are seeking?

That all is quite misleading. It sounds like they rolled paid sick time into a general PTO pool that provides about 5 weeks off paid time off per year for sickness or vacation, and agreed to supplemental sickness benefits like being paid for short term disability if they are out for illness more than 4 days.

Paid time off isn't useful for sick days or doctors appointments if you need to book it weeks/months in advance and you're penalized for taking days off on shorter notice. The fact is, railway workers are basically expected to be on call 24/7, and due to the point-based attendance system, they basically have no choice but to be available if they want to keep their jobs.

Quote:
Many rail employees are required to work 12 hours a day and are frequently on-call 24 hours a day, seven days a week. When scheduling time off, rail workers say they often have to make the requests months in advance.
...
“These guys are forgoing their doctor’s appointments or when they’re sick just to make sure that they have points in case an actual emergency arises,” Cassity said, “And they’re being forced to work more and more.”

Then extend the temporary agreement. Forcing a CBA through congress isn't much better than the crap Reagan did in the 80s.

I don't really know the details of this agreement but this is definitely true. Railway cargo is giant business in the US (and Canada) - a huge portion of all the goods that come across on cargo ships ends up on trains to get into Mid-west/East coast US and Ontario/Quebec in Canada.

Would probably be a boon for Canada companies if the US ones went on strike as companies would try to divert their product up to Canadian ports and ship it across Canada by train before driving it from Ontario/Quebec to the mid-west distribution hubs. We'd have no where near the capacity to cover it though.

this is some prime 4D chess here. Threaten to disenfranchise a whole county of their perfectly fine votes, claim they were then forced to certify the election and take this as proof that the election was fraudulent, sow further distrust in the whole election process and lay the groundwork for the next election where they will undoubtedly do the same thing again. Unless they win, of course.

but yeah, somehow this will again be the fault of Katie Hobbs and her woke libtards. Flawless logic.

It does make sense if you believe that Democrats and RINOs are both engaged in so much cheating that your only option is to spit into the wind.

House committee finally gets Trump's tax returns today after 3 years of legal battles. I wonder if Dems can still review them after the House and committee leadership changes over to Republicans.
