Leafs traded for Cowen with no intention of playing him (dick move, but Leafs don't have to play him). They told Cowen they were going to buy him out in the summer and he was free to talk to other teams that were interested.
That summer Cowen gets surgery from a doctor with no connection to the NHL without contacting the Leafs or the NHL. Then when the Leafs try to buy him out he claims he can't be bought out because he is injured and still recovering from the surgery.
Leafs say at the end of the season you were not injured and you did not consult us about this injury...it went to arbitration and it was decided in the Leafs favour.
So now he is on a PTO for the Avs. It will be interesting to see if he can make the team.

I guess NHL teams have found uncommonly generous insurance companies who are OK paying out millions of dollars on warrantless claims. Weird, every other insurance company I know of will twist themselves into pretzels to avoid payouts of any kind. Just lucky for the NHL, I guess.

I agree but what's to say the Leafs aren't simply cutting a check to the insurance company to cover the costs?

You're assuming that Lupul's contract is even insured - or that the Leafs are making a claim against that insurance. Neither is guaranteed.

I am assuming that virtually every one-way NHL contract is insured, yes. But good point about the claim.

The ironic part is it's situations like this which lead to higher escrow payments.

I like how the term "Robidas Island" has apparently become official.

Is this a good assumption? Unclear - I thought only players above a specific dollar amount (both term and AAV) were generally insured

Lupul is always injured, he likely just actually is still injured.

I would suspect that most players are not insured - generally just the higher paid ones would be.
For a higher paid player, you not only have to pay the injured player on LTIR, but likely have to pay another high priced player to take their place.
For a guy making league minimum, the team just replaces that player with another player already being paid - not a big deal.

Seems legit. Shouldn't the league have their own team of doctors by now? Or would that place liability on them in terms of concussion protocol and long term injury lawsuits? Can they insure against lawsuits?

Why would the league even want to maintain its own set of doctors? That would just be a duplication of resources since all teams already have their own doctors. And the process for Lupul to seek independent second and third opinion has already been posted in this thread. Presumably he's following those options.

According to LeBrun Lupul hasn't gone the 2nd opinion route yet:
Pierre LeBrun
@PierreVLeBrun
One thing to keep in mind on Lupul: he has the right as per the CBA to seek a 2nd medical opinion via the NHLPA re: failed physical (con't)

Replying to @PierreVLeBrun
Lupul hasn't done that. or at least not yet. But that's his right.

Many players don't have their contracts insured, even larger contracts. Nathan Horton's contract wasn't insured and was a big reason why he was traded for Clarkson.

I could make the Avs this season and I can barely skate. They are going to be that bad.
