In my personal, anecdotal experience, its because natives get preferential sentencing.

If forever is the answer, then there will never truely be a healing within the native community.
As a white first generation immigrant to this country, it seems to be that there needs to be a point where the native community believes that the "debt has been paid".
I don't know what that point is, I believe that if it continues on forever, then there will never truely be a healing of the native community, nor will there ever be true forgiveness.
It will take a very strong man/women to stand up.

I bet the ~70% of the prison population are sure glad they got preferential sentencing.
(note: it might not be 70%, and I dont really want to look it up right now, but it is drastically higher than the proportion of natives in the population)

I think the "debt" perspective is actually an underpinning foundation of the reserve setup. There seems to be this proverbial "Berlin Wall" (both physically and psychologically) between the reserves and Canadian society, which has created a sense of distrust and finger pointing. Until that goes away and full societal integration can be achieved (which may never happen), I think there will be this perpetual silo mentality that will be used as a crux to say the "debt" hasn't been repaid.
This is such a deep and sensitive topic, but I do believe physical segregation is part and parcel of the cause.

The opportunity for integration has existed for many years but isn't something that is enticing enough. It is a sad fact but the percentage of the FN community that wants to actually contribute to Canadian society as a whole is quite small. They have essentially endless resources and countless programs to get themselves into society but they just don't care. The few that do go outside the reserve and better themselves are largely ostracized by the FN community.

Drastically more natives get sent to prison than any other demographic.
This means that the likelihood of preferential sentencing in the regular court system actually existing in the manner which you are saying, is not very high.
That said, there are alternative native sentencing options that exist, however, unless I am misreading, or it has been misreported, they were not involved in why these people were on the street.
