He didn't officially retire until the end of July last year. Because of that, I would bet his inclusion last year was still governed under the NHLPA licensing agreement.
Now that he has officially retired, his inclusion would be governed under the Alumni Association's licensing agreement. If he hasn't signed off on the Alumni Association's agreement, they probably can't use him in the game until he does.

List of players I saw didn’t include Bobby Orr, Phil Esposito, Rocket Richard. So these may be alumni teams but obviously not all time greatest teams.

It just occurred to me that this might only include active members of each teams Alumni Club, or whatever they might have. If you didn't pay your dues, no EA team for you.

Maybe you have to play a certain amount, unlock the Quebec Nordiques Alumni Team before he shows up on Philly's Roster?
