There's no way the NHL (or any other business) would prefer to settle via the courts rather than via arbitration. Arbitration awards are typically lower, far less public, and don't run the same risk of a public airing of dirty laundry if the two sides cannot come to an agreement beforehand.

Also, the precedent is very important for the NHL.

You don't have to think he is making his injury up to know that he was not going to be back as a linesman in any event. That's pretty common knowledge.

dino, his ask wasn't "laughed out of court". It was dismissed on procedural grounds. There's a world of difference.

What about the other time he got smoked just as bad or worse in the pre-season

where is the lawsuit for that one?

Sorry, guy got knocked over not attacked during a hockey game and was a month away from being out of the league. Lawsuit is ridiculous especially with those figures.

I like this conspiracy theory though. I mean, I can totally picture Don Henderson sitting back in his living room after that game, laughing maniacally as he hatches this plan to have neck surgery so he can get some money. And with Dr. Nick Riviera and Lionel Hutz, Esq. at his side, easy money. amirite?

Yeah nobody has ever stretched the truth for money...not sure why I bother with this, you have been on me about it for two years looking back. You even try to deny that they were sharing a laugh right after the incident. I mean it was about 10 feet away from me but you would know better I guess.

What exactly is your point? he is entitled to money?

Injuries (which could very well be cumulative) happen in hockey

He got run over during a hockey game, not attacked (why would he joke and laugh with a guy who just attacked him? Why would someone attack a linesman) lawyers obviously got him to change his story to attacked. Wideman looked up at the last second and braced himself...it happens and had obviously happened to him before.

The FACT he was laughing about it right after, worked the rest of the game with an intermission break, his career was almost over, and his ridiculous ask makes me suspicious.

Only he knows for sure I guess...either way he isnt entitled to any money IMO

This will be the last I discuss this, wasted too much time on it already

It's quite possible that the damages he claims are legitimate, or they may be frivolous or exaggerated. No one here really knows for sure.

Well, the monetary damages are pretty easy to establish. Insurance defence lawyers deal with these kind of claims all the time. Loss of income, medical expense (which is all for Alberta health care anyway), miscellaneous items, and a set capped amount for pain and suffering under Canadian law.

They should be on the hook for the entire legal costs for the Flames. Other than employing Dennis Wideman, I cannot see any reason why the Calgary Flames could be found to be negligent in this situation.
They went for the long ball and missed. They are out $11,000, which is getting off pretty easy for launching a law suit that never should have went forward in my opinion.
Hopefully he gets a fair settlement from the league and moves on.
