It's much closer to criminal negligence (and probably is) than distracted driving.

Guy wasn't very smart. If you want to get a good rest you are better to set it at the speed limit and get a longer sleep. Amateur.

You can't stop full stupid.

Splitting hairs, but as I hinted in my previous posts, I have no issue throwing reckless driving and/or stunting as part of the speeding ticket. I just vehemently disagree on DUI.

Why do they issue DUI over something like reckless driving?
What he did should be criminal.

I equate it to a DUI because he impaired himself beyond the condition requires to safely operate a vehicle. Excessive fatigue should also have the same consequences. As should cell phone use. When you intentionally impair your ability to drive to a similar extent as .08 then the consequence of that action should be the same. It this case, presuming the story is true, this guy was as impaired as someone who was passed out.

Speeding yes.

Dangerous driving is going to be an interesting case for the prosecutor. One could easily argue that this car was being driven the safest out of any car on the road that day.

That being said, the driver was clearly not driving the car in a manner that is legal here, nor in a manner that is recommended by the manufacturer.

At some point in the coming years, laws will have to be changed to better cover things like this. But it’s not likely now.
