As much as people don't like the insanity defense it seems to protect society better than people with mental issues in the criminal system. These people might never get out if they had gone with an insanity plee.
People who can't conform to society as a result of things they do not control need to be removed from society to protect it.

I don't really see how being stupid or having FAS is an ncr defense. Having a psychotic break from reality is one thing. And one of the guys is schizophrenic as well. But this doesn't seem like a crime done by people who are out of touch with reality. They seem very much connected to what is real. I'm sure beyond a shadow of a doubt that they would benefit from counseling more so than jail. But I'm not sure they deserve less punishment than what is due any other rapist/kidnapper. If they get the standard aboriginal get out of jail free sentence I'll puke.

If the low IQ combined with FAS means that they clearly can't tell right from wrong and are going to give into an impulse to kidnap, sodomize and rape a girl, then realistically in the name of public safety they should be put away and never ever get out.
Even if the defense is, they couldn't help themselves, then that alone should condemn them from being separated from society.

Pretty good but still hate concurrent sentencing and time served bonus.
Interesting that there was no NCR verdict because the judge considered it impossible to rehabilitate them. That's sad.

That'd be nice but sadly it's their first offense and you're not a dangerous offender until you have a history. I do wish the sentence were much longer but I understand why it's not.

It is sad that as Canadians we consider a 12 year sentence for something this terrible "stiff". Those two pieces of human garbage need to be work food.

Yup, I agree but seeing how sentencing usually goes I think this is a decent amount of time in jail. I wonder if we hear about these guys again once released from prison.

Almost certainly would. Too low of an IQ to truly understand the consequences of their actions, no moral compass, there's not much of a chance they are rehabilitated. Unfortunately, I think best case scenario is you see these guys get caught doing something stupid but not life-altering to someone (i.e. get caught breaking into a car or something) and being sent right back. Otherwise, I hate to say it, but you hope they do something stupid in prison that either extends their time or gets them an 'early exit.'
Ideal world they are found NCR and put in a mental facility that would take care of them the rest of their lives with no chance of ever being out unsupervised.
