Well there are a few problems here,
#1 you are using the Joe Rogen podcast as a source of information, even worse you seem to find it entertaining.
#2 the lawyer made a terrible argument, he shouldn't be special pleading similar things in favour of his side.
#3 they were almost certainly working from a cherry picked data set. I'm certain it's pretty ease to find left wing people on twitter who were banned for something a right wing person said who was not banned. These isolated instance do not equate to proof of bias on either side.
#4 Even if once side is subject to more bans than the other side, it does not equate to proof of bias, because it's genuinely possible that one side it just more likely to break the terms of service and get reported, both of which would be required to be considered for a ban.
