UBER has come out quickly and said this is not permitted by it's drivers due to privacy so that is a clear indication it is not ok from both a professional and personal standpoint as I would have assumed. Hopefully this driver is promptly terminated.

I would wager the vast majority of people in this world have said something of poor taste about a boss or co-worker that they later regret in a cab or at a pub after a few drinks. I cannot imagine finding out something like that was recorded and released. Proper or not, the players or anyone for that matter, should not have to worry about being recorded by a cab driver of all people.

What's not permitted? Recording passengers, or releasing the recordings?

You think it's not bad because you agree with their assessment? That's not really why anyone would think it's bad. The comments about not paying attention, and dissing the coaches is what people are going to react to. Are these guys you'd want to coach if you are on another team?

Well the Flames checked out on Hartley when he was dead man walking, and checked out on Gulutzan when he was dead man walking. We all watched it and it was ugly.

They basically may well have done just what the Ottawa guys talked about. (Maybe they even talked about it in a cab but it so happened that the driver wasn’t a dirtbag.)

Would you want to coach them?

Depends on a few factors, but from my understanding what you can record (both audio and video are different within this) and what you can make public are also different here.

In most of the U.S., you can record anything if there is no reasonable expectation of privacy. So you can record someone on a public street without their permission as there is no reasonable expectation of privacy on a public street. But you can't do so in a bathroom, for example, as there is a reasonable expectation of privacy in a bathroom, even a public one.

Additionally, you can record without permission if doing so on or within your own property. Same rules apply for reasonable expectation of privacy, but a vehicle is considered private property in the U.S., so this Uber driver can legally record without permission. He may be breaking Uber rules, but he isn't breaking any U.S. laws. If you're in someone else's vehicle, you have no reasonable expectation of privacy. However, someone else can't legally record you in your own vehicle without permission since there is a reasonable expectation of privacy when you're in your own vehicle.

I think if I was a GM of another team the biggest concern I would have was the company Duchene was stating this in.

If this was Anderson, Duchene, Wideman, Stone, & Zack Smith as a team full of 5 veterans blowing steam that is fine.

But for Duchene and Wideman to be in the taxi with 3 guys that are pretty much rookies in Chabot, Formenton, and Demelo, and a guy who's been there for 15 games in Tierney.

Telling a bunch of other rookies and newcomers that you haven't been paying attention to video for 3 weeks, and acting like it's acceptable is not really an example that's good for the culture of a team.

The more I look at it the more I think it's maybe not a surprise that losing seems to be following Duchene and O'Reilly wherever they go.

I didn't hear them publicly dissing Hartley. I heard they took their issues to Treliving. And I heard them take themselves to task when the firings occurred.
So big difference.

I think releasing the recordings (or maybe making any use of them other than for security).

I would think they store them for security reasons and also if there's a fare/credit card dispute, or maybe a dispute about some interaction between driver and passenger. I know I've seen other recordings released where some passenger was acting like an idiot.
