This season . . . wow . . . and that's not a good wow, from the Dan thing, to a completely unlikeable cast with no real strong players that you can get behind. Its a combination of a dud and yuck.
Maybe after all of these season, we finally had one that scraped the bottom of the barrel.

‘The final straw reportedly dropped after an immunity challenge, and involved someone on the crew as they were getting into a boat to leave. It's unclear exactly what happened during the incident, but it was enough to get him booted.’

I’ll be honest and say I stopped watching halfway through the first Dan episode I was so disgusted with the producers and cast. I’ll have to see how they apologize and explain themselves following the season finale to decide if I return as a viewer. The explanations and apologies thus far have been lacking.

The Jeff thing was in daytime, so there are a few possibilities on the timeline of everything.
Given the nature of of production, it's possible it just takes time (ie. 1-2 days) for an allegation to be made, and then to get the necessary people in the same room at the same time to investigate and make a decision (including Dan).
It's even possible that they came to the decision to remove Dan before tribal council, but if it's only a few hours before the vote, it's a tough dilemma on exactly when to yank him. Since this issue didn't involve other players, I don't necessarily think it's the wrong call to leave him in for the vote. Didn't catch how many torches were walking back on the last shot?
I would bet that Dan didn't go back with the tribe that night, and they had the night to speculate about it.

How this going to effect the jury, with Dan ejected we're going to have an even jury, there's now a possibility of ties.

No because there's always an odd number of votes.
because the jury will be 10 instead of 11 with dan's ejection, the third place finisher could get 0 or 2 votes and you would have the possibility of a 5 5 or 4 4 tie.
With an 11 man jury a 3 way or 2 way tie is impossible.
Right now we have an 8 man jury with 2 votes left.

There isn’t always an odd number and we’ve already seen a tie. Ghost island had a jury of 10 and the votes where 5-5. The third place finisher placed the deciding vote.
Heroes v Healers v Hustlers had 8 jury members. David vs Goliath and Game Changers has 10.
It has never been revealed as to what happens at a 3 way tie though.

They probably just let Cia decide.
Have they ever had a 9 person jury with a final 3? Seems simple enough to avoid 9 for 3 or an even number for a final 2...
It seems like they might have anticipated this problem by putting Jack on the jury before the merge. Aiming for 11 jurors seems sensible regardless because a med-evac (or creep evac) could easily turn your planned 10 jury into a 9.

There have been 23 seasons with a final 3.
9 person jury is the most common at 8.
7 person jury x 3
8 person jury x 6
10 person jury x 4
11 person jury x 1
13 person jury x 1

I can see why a 3 way tie isn't really expected to happen. I've never gone into a Final Tribal thinking "Gee, anyone could take this." There are usually 1-2 favorites. I may be wrong about who actually wins, but by the time you get to the Final (Number), there is usually a frontrunner, and the question is more "will the 3rd person get a pity vote or not?" over "Will there be a tie?"
