I think I may have misinterpreted the DoPS' stance on this, upon doing some further research. I believe Sundin may have been suspended because the referees in charge of officiating that game failed to assess the appropriate misconduct penalty to Sundin during the game -- something that they were disciplined for -- and the DoPS penalized Sundin to make up for it.
In that case, since Backlund was penalized appropriately in-game, he should avoid further discipline.
