Making no comment on the merit of the position, I can explain what appears to have happened from my reading of the news story...
The Chief Crown agreed KJJ was 'probably' a candidate for release because he has already served 2 weeks in remand subsequent to being arrested and accused (presumed innocent regardless of the apparent strength of the case in the media reports) of being unlawfully at large.
14 days pre-trial remand time would regularly be considered a sentence of 21 days.
Crown prosecutors have an obligation to consider agreeing to release for accused people who would be already at 'time served' if found guilty. It appears based on what he knows the Crown considers it reasonably possible they will prove the charge but KJJ will not get more jail time for it than what he has already done.
In this context, it is worth noting that full house arrest with conditions as strict as what were ordered can also be given credit as against any ultimate jail sentence (ordinarily much less than a 1:1 credit but credit nonetheless).
