Default Man Driving a Hummer Not a Dbag? Saves Edmonton Kids!

Man that dbag on the cellphone needs to have his license taken away. I hope his insurance doesn't cover this and he will have to pay every penny out of his pocket. Just pathetic.

Krushelnicki was waiting to turn left at the intersection, so he pulled up a bit further, hoping the man driving the Pontiac would notice him or the other vehicles stopped at the crosswalk.
The driver didn’t.
Krushelnicki said it looked like the man was distracted by a cellphone.
“He didn’t have any attention to the crosswalk and the kids,” Krushelnicki said. “I was quite sure he was going to hit them.”

Police responded to the crash at 4:25 p.m., police spokesman Scott Pattison said Tuesday. Witnesses told traffic investigators that the driver of a 2007 Pontiac G5 was talking on his cellphone while speeding north on 83rd Street from 82nd Avenue, toward the crosswalk.
The Pontiac was going faster than 80 km/h, Pattison said. When a crosswalk’s lights are flashing the maximum speed allowed is 30 km/h.

While I echo your thoughts, but it will have no effect on his insurer's response, other than to bend him over come renewal time

I would suggest it will.

It is public opinion suicide not to cover the hummer's damage.

Lol insurance companies don't give a rats arse about public opinion when dealing with claims.

If they are legally obligated to pay, they will. If not, they definitely won't. Insurance companies aren't in the habit of giving away money they don't have to.

He isnt from Edmonton @ all. He was from Taber and works in BC. He was only visiting Edmonton.

Still a d-bag for driving a hummer. Good for him on saving some lives.

I know there are posters on here that are adjusters, and I am sure they will tell you that they have covered claims that were not a coverable loss, because the individual was a pain in the a$$ and called everyone and their dog.

I'd really love to hear these stories. I've never heard of an insurance company paying for something they don't have to. Please show some examples.

I am not an adjuster. However I have friends that are. It happens, just because it is not within you knowledge does not mean it doesn't.

If one of the posters on here that is an adjuster sees this they will hopefully respond.

Good for the guy in the H3 ... Unfortunatly the guy in the pontiac is going to get away scot-free. Even the worst lawyer has to be able to get this guy off the hook.

Not only will the pontiac driver get off scott free he will get an injury settlement for his trouble. The Hummer was clearly at fault here in insurance eyes.

As stated above insurance does not cover deliberate acts and the hummers damage may not get covered. No company wants this bad press and in my experience I have found that the most effective way for claims to be paid that technically shouldn't is to go to the media. This claim will get paid its already in the media spotlight.
