And I understand she's not able to legally consent... however is it not her that broke the law and not him? Or is it up to the 16 year old to know the law on this? Man I am confused.

The reality is kids do stupid things, and peer pressure is one of the worst kinds of pressures out there. We were all kids once. I'm sure we've all had at least some experiences where we've done some pretty stupid things that we knew was bad, but we still did it because we were egged on by our peers.

I agree with Peter12 that society is collapsing around us, and the better indication of this is the sad fact that so many posters on this forum seem to think a 16 year old MAN having sex with a 12 year old GIRL, really isn't that big a deal.
"the 16 year old wasn't as big of a monster as we all thought". "The reality is kids do stupid things" WTF?
THE GIRL WAS 12!!
"If the 12 year old girl consented"????? "It may not have been imoral (sic)"????? Is that what you tell yourself when you take your annual trip to Thailand?
"12 isn't that young"????? WTF?
Where do YOU draw the line? 11? Or is it okay if she looks 12?

A 12 year old having consensual sex in a public location with a 16 year old is no where near as bad as a 16 year old forceably raping a 12 year old in front of his onlooking friends.
Not saying both are not bad, but there are different degrees of bad.

So reading between the lines this was consensual. That doesn't make it right, but it is a heck of a lot different than a young girl was grabbed and raped in the middle of the day in a schoolyard.

Back in ye olde days, a 12 year old might be betrothed and soon married off to some old man as a second or third wife (with the others having died in childbirth or of illness) and expected to bear children as soon as she was physically capable.
But don't let fact get in the way of a good "societal collapse" rant.

I have never in my life, meet a 16 year old man. Sixteen year olds aren't men, no matter how much you capitalize the word.
From what I read in the Herald this morning they are reviewing the chat logs to determine what they talked about. I think it's entirely possible the girl lied about her age. The site in question where they "meet" has a minimum age of 13, so the possibility of deception on the girls part is high.
Am I saying what happened is right?
No, definitely not. But for the people who want to hang this kid by the balls, or are declaring the end of civilization as we know it... blowing it way out of proportion.

Which "ye old days?" I'm aware it happened before, but let's not draw such silly generalizations of the past.

What silly generalizations? It's fun to make smart remarks, but what exactly do you mean? You don't think a public rape would be some sort of sign of social degeneration or even remotely concerning for a community?
EDIT: Maybe I wasn't clear when I said "social collapse." What I meant was collapse at the local or city level. I'm not talking about some sort of grand Roman collapse.

Social collapse of the school yard maybe, but the city? That's still a bit of a reach.

It was/is common practice in practically every society up until/except the modern, secular Western society we live in today. Another example of the moral progress you're so sure hasn't occured, actually occuring.
Which is it? Is marriage and the subsequent sexual activity of barely pubescent girls morally repugnant, or is that repugnance merely a cultural oddity of the decadent West?

Quite obvious you don't have a kid. Twelve is THAT young guys.
My daughter will be 12 next summer. Her friends are all around her age, give or take 6-12 months.
They like to watch Camp Rock, iCarly, Suite Life.....stupid KIDS shows that KIDS like to watch. They have sleepovers, eat popcorn, drink root beer...and watch stupid KIDS shows. They like to do dumb finger painting pictures for Mom and Dad....because they're KIDS. They'll even play with playdough still when they're really bored! Last weekend one of her friends was over. She had brought her barbies. They had a barbie sleepover....because they're still KIDS.
Now I know these days of innocence are winding down for me. We're lucky we have a respectful daughter with relatively good friends. But my point is that girl was just that...a young girl. She's not far removed from the things my girl and her friends do now. Fact is if she had parents and friends/family who were a little more interested in her well being, that's more likely where she might be.
Twelve is far to young to be meeting up with horny 16 yr olds on Facebook. Obviously it's too young to be getting drunk and screwing as well.
It really all gets back to parenting. If your kid is busy with interests, activities, etc., I doubt this happens, let alone at 4:30 on a Monday afternoon.
"Stuff not far from this" has always happened and always will I suppose. It doesn't make it right, and I can assure you that the huge majority of those involved have parents or guardians with more important things on their agenda, rather than the well being of their tweener.

Your daughter may be watching Camp Rock to get an eyeful of those young, virile, Jonas Brothers...
