A patent lawyer would need to clarify, but the gist I heard from a podcast was that if you have a patent and somebody crosses the line you basically have to sue them.

Apple has so much money at this point I can't imagine the lawsuits directly impact the users.

Apple has sued Samsung, Samsung has sued Apple in return, iPad uses many products fabricated by Samsung.

This will carry on until both sides have an idea which way a ruling will go, then they will negotiate a settlement via an exchange of patent rights and/or fab architecture.

There are so many lawsuits right now between so many companies that it will take years to sort out and by the time it does the issue will have long since devolved into obsolescence and a new set of lawsuits will have taken over. IP lawyers are a growth area.

The important thing about what I posted wasn't that Apple is suing Samsung, it was that Samsung was ordered to turn over 5 unreleased products to Apple by a federal judge.

So basically from the article, everyone was happy and all the phone manufacturer's had cross licensing and fair use agreements with each other until Apple decided not to play ball by paying the licensing fees and started suing everyone.

It is harming the consumer in a lot of ways. Patent costs are rising with the rate of litigation and now make up 15-20% of a smart phone's selling price. If the litigation goes up so will the costs of our products.
Maybe, but there is enough blame to go around. It is a burgeoning area and with the way the patent system is set up and the rapid rate of change, this was bound to happen. Perhaps Apple through more early punches, but there were lots of competitors waiting for the bell.

Updated the Transformer to Android 3.1 this week, and improvements in performance are noticeable. It just doesn't seem as laggy with touch.

The NE store didn't when I went in to pick one up at lunch just now. I think they're in too high demand to bother wasting one of their stock as a demo unit. I think this is only the second shipment they've received and the guy who works there said that the first shipment was all spoken for by employees so not a single unit was even available to the public.

I was in Waterloo last night talking with a good friend who works at RIM. It's pretty clear that the Playbook was intended to be an enterprise device, not a consumer device, and that was a big swing and a miss from RIM. He said that the whole lack of native email client was designed with the vision that the Playbook would be an IT device that could be handed out to people who needed something like a laptop, but not quite a laptop, like the iPad, and with pairing with the users blackberry they had their entire profile with the device.

Of course the problem is that the Playbook is entering into a market that is consumer driven, not enterprise driven.

Basically the sentiment from him and others at RIM is that they need to transition to being a software company that makes secure OS's not a hardware company that is rapidly falling behind when it comes to devices.
