I don't know if you're being sarcastic or not. Of course that is why they are there, but I would think it's pretty common knowledge that there is a HUGE difference in the level of defense one gets depending on how much one spends on a lawyer. Even in this country.
Yeah I agree the murder is a big stretch, it just wouldn't surprise me at all at this point.
For the public defender thing, obviously the quality is higher if you can afford it, but the "didnt have enough evidence for a search" thing seems pretty straight forward. Although maybe it isn't, I'm not a lawyer.

Yeah I'm not a lawyer either, but if there is a grey area in this case, I could see how many cases would have it. And as for debating how much evidence is required for a search, shoot, it's something you hear about all the time, both in real life, and in dramas, so obviously it's something that can be argued both ways.
For lack of a better understanding I would argue, that at least from a citizens standpoint nothing in law is 'straight forward' even often the laws themselves. That's why we have lawyers and courts.
It sounds like a Rob Ford may have a defamation suit against him, based on his interview with Conrad Black this eve. Specifically, on his allegations on Toronto Star reporter, Daniel Dale.

Just when you thought it wasn’t possible for the relationship between the Toronto Star and Rob Ford to get worse, the mayor reached a new level of inflammatory rhetoric Monday night when he insinuated that he thought a Star reporter was a pedophile.
"When a guy’s taking pictures of little kids,” Ford said. “I don’t want to say that word but you start thinking, ‘What’s this guy all about?’”
Maybe its me, but the mayor of one of the worlds biggest cities probably shouldn't be suggesting a reporter is a pedophile.
As to Robert, well, where exactly is this guys rock bottom? I get the feeling his rock bottom will be coinciding with his death, imprisonment, or both.

I got his rock bottom right here!

I was generous. I didn’t call the mayor a liar.
Perhaps he was somehow misled by an excitable neighbour. Perhaps he somehow thought he saw something he didn’t see. He tried to get me arrested, to destroy my career; I decided to correct him gently, deferentially.
Not any more. Not 19 months later. Rob Ford is lying about me, he knows it, and it’s vile.
Ford spoke to Conrad Black, the Vision TV host, about the encounter he had with me on May 2, 2012. Literally every single thing Ford told Black about my conduct that evening is false in some way.
I’ve received advice from a lawyer, but I haven’t yet decided whether to take legal action. For now, let’s review Ford’s words lie by lie:
Ford is a disaster and needs to resign immediately, but I give him a free pass on this one. I think his statement during the Conrad Black interview falls under a fair comment. I have little doubt that Dale was poking around in Ford's backyard and appeared to be taking pictures while his kids were there. If someone did that to anyone else's children, they would likely have similar thoughts.

Did you read the linked article? According to the police investigation into the incident, Dale did not trespass on Ford's property, nor did he take any photographs of Ford's home that evening. He also had a legitimate journalistic reason to be there (he was assigned to investigate a story in which Ford was requesting to buy a patch of publicly-owned park space adjacent to his home).

He had a camera and Ford said that he was on the boarder of his property taking pictures of his backyard, so it becomes a "he said, he said" situation. Obviously, if Dale were doing what Ford claims, he would not admit to it. Don't get me wrong, Ford is a terrible mayor and there are many reasons why he should step down, but I don't really have any issue with his comments regarding Dale.

It's not a "he said, he said" situation. The Police investigated, and have backed up Dale's side of the story.
You don't have problem's with Ford threatening Dale at the time of the incident, and essentially calling Dale a Pedophile? Really?

Fair enough. Having read the article now, it seems more likely that Ford made his side of the story up. I take my previous comments back, that was not a fair comment.
