Second DUI - License suspended for 10 years. 2 years in jail....no early-release.
Third DUI - License suspended for life. 5 years in jail....no early-release.
Kill someone in a DUI-related accident - License suspended for life. 15 years jail for every person you kill.
Everyone makes mistakes, but this is one of those stupid irresponsible ones that no one should ever have an excuse for. Make the first one one really harsh so people have a chance to correct their behavior. My guess is that if someone has multiple DUI's, there's really no turning back for them as they just don't give a crap.

Would you give someone 15 years if they ran a red light and killed someone? Both are equally reckless behaviors.

Had an idea!

If it can be proven that someone actually RAN the red light, why not? Its not hard to properly obey traffic laws. Some of us actually manage to drive our whole lives without getting a single driving infraction.

One thing i think people are missing is this guy wasnt driving 180 because he was drunk. I woud suspect this guy was a generally wreckess driver. I think we are nottpugh enough on dangerous drivers in general. Driving 180 for whatever reason should have the same consequences as drunk driving.

So glad to see that the punishment for killing someone is now the same as attempting to rob a business.
Judge in the case is a joke and a disgrace to the legal profession.

Frack me. Disgusting.
Wife dies in husband's arms after being hit by alleged drunk driver
Once police arrived Jaswal was escorted to a cruiser asking “is my car going to be okay?” while being moved, the prosecutor said.

You know maybe bad guys do finish first? Being more concerned with his car than the innocent person that he killed kind of shows that this simply isn't a good person and the laws seem to be kind to people of this type.

Judges are bound to apply the Criminal Code and sentencing guidelines in similar cases. Parliament could enact stricter sentences.
http://en.wikibooks.org/wiki/Canadia..._Motor_Vehicle
Dangerous operation causing death
(4) Every one who commits an offence under subsection (1) and thereby causes the death of any other person is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years.
See page 7 here for a chart:
http://www.madd.ca/media/docs/MADD_C...work_FINAL.pdf
Rather than advocating for minimum sentences, MADD Canada has set out below what it believes to be a range of appropriate sentences for impaired driving causing death.
In establishing the following sentencing ranges, MADD Canada has sought to reflect the gravity of the offence of impaired driving causing death, taking into account the major aggravating and mitigating factors.
The proposed sentencing guidelines call for considerably longer sentences of incarceration than are currently imposed upon such offenders.

OK, judges & prosecutors shrug their shoulders and say "Hey, the sentence is in line with the law". My MLA is a carcass who is only interested in getting re-elected. How on earth do we get laws like this changed?
Edit: If it is a federal thing, then my MP is Harper. He doesn't seem too close to the constituents either.

This was the car . . . how drunk was he to even ask while his victim was dying? Plenty.

I don't want to defend the guy for his actions, especially the ones that lead to the accident, but this statement is likely the result of the 'flight or fight response.' You don't process things the same way during and directly after (or unfortunately long-term) an experience where you go through an adrenaline rush. "Sensory overload" is very common and can result in critical incident amnesia, essentially short-term memory loss, but can have other effects, fixation being one of them. Fixating on something 'irrelevant' isn't an unusual response after a high-stress situation. It's a possibility that he was focusing on his car, not because he's a terrible human being, but because that was his uncontrolled response to the situation and really asking that to the officer is pretty nonsensical.
Or he's a ######.

Assuming minimum level, he should have gotten the maximum (4 years) and a lifetime driving ban.

If you look at what he pleaded too there's no mention of impaired driving.

He pleaded guilty to dangerous driving causing death, dangerous driving causing bodily harm and refusing a breath test. In return he got a slap on the wrist and will go back to driving.

Dude was more concerned about his C63 than the people he hit. Sucks he only got 3 years, should have been 10.

As a prosecutor, you can ask for the moon, but you won't come close to getting it. Sentences are determined based on comparable case law and any relevant sentencing guidelines from the court of appeal and Supreme Court of Canada. Be as mad as you want at the trial judge, if he imposed a sentence of ten or twenty years, it would just be quickly appealed and drastically reduced by the court of appeal.
When I practiced in Manitoba, the court of appeal there said the sentencing range for Impaired driving causing death was 2-5 years for a 1st offender. For someone with previous impaired convictions, it was 4-7 years.
Be mad at your MP. Ask him to get sentences changed for laws. That's the only way it will change.

What do you expect from Canada? Drunks, pedofiles and murderers are welcome, light sentences all around.
