I think he got a 24 hour license suspension which is a provincial suspension for mere suspicion of drinking and driving.

A DUI or impaired driving is a criminal charge for either:

1) Driving while ones ability to operate was impaired (alcohol or other means) and is based on a coppers observations

and/or

2) A breath sample of over 80mg% (which is kind of misleading as a breath sample is truncated with a +/- error of 10mg%... thus one could blow 99mg% and bingo, bango, bongo your name is thesmugger... but i digress).
