It's still a silly argument. The feds make all sorts of laws protecting the environment that companies must adhere to that impacts profitability. Why is the air any different?
Like, Alberta couldn't make a nuclear reactor that burped out radioactive radiation downwind into Saskatchewan. There are reasons for national rules and standards. We are a country, not a collection of fiefdoms.

We're not disagreeing... your example isn't even necessary; you don't need to show that he subject matter of the regulatory regime would affect a neighbouring province for it to be within Federal purview. As I said, any argument that might be made from the Province's side is probably ultimately doomed, which is what Mbates said and he obviously knows what he's talking about here.
Outside of the constitutional law realm, though, the political reality is that some provinces simply have more leeway to ignore constitutional law based on whether the current Federal government cares about whether people there are pissed off at them.

Recent statistics from the Court of King's Bench show 22 per cent of active criminal cases in Alberta have exceeded what's known as the Jordan period — the rule that sets out reasonable time limits to get to trial.
Fewer Jordan applications are being approved, but the proportion of cases exceeding those timelines has grown in recent years.
"It is difficult on the accused because it's a huge unknown sitting on their shoulders for months or years before they get a final answer," said Danielle Boisvert, former president of the Criminal Trial Lawyers' Association. "It's very stressful for the victims and the families of victims in terms of the waiting times and not knowing what will happen."
She added the courts monitor case timelines and will often triple book to avoid bumping against Jordan timelines. Boisvert said judge vacancies need to be filled, but more courtrooms are needed as well as support staff like clerks and sheriffs.
"It doesn't matter how many judges you have there if you don't have the other people necessary in the courtroom.

I just have a hard time understanding why anyone would give someone an important cabinet position when they intentionally make themselves look like a Die Hard villain

This is why you should ALWAYS plead not guilty to a photo enforcement ticket. Photo enforcement tickets in Edmonton, especially.
