Default Another situation.....

Okay, it is my turn here to look for CP advice on dealing with PayPal disputes.

In late October, I ordered 4 items and sent the money to an email address (the seller lives in China). I have friends who had done this numerous times with this seller, and never had problems. Well after months of them saying, ?we don?t have this item in stock, we don?t have that item in stock? they end up sending me only 1 of the 4 items. They acknowledged only 1 of the 4 was sent, and as me to pick other products.

I asked for a refund, and they said sure, but this was over a month ago. They have now been ignoring me ever since. I tried to file a dispute with PayPal, and they said the transaction is over 45 days old, and they won't deal with it, same goes for Visa.

To me, I?m pretty disappointed in PayPal, because I have email proof of them stringing me along for months, then acknowledging they didn?t send 3 of the 4 items, yet they don?t want to do anything about it. Nice buyer protection.

Any advice for me? Any way I can escalate my case within PayPal?

Well to start as soon as you have any problem with a transaction on ebay/paypal put in a dispute because you can always cancel it and like most companies they have a set time you can file.

For your situation you may be screwed but I would keep bugging the seller by email. I wouldn't threaten too much because I would assume they know the rules and how long someone has to dispute a transaction. You could be SOL and depending on the money spent it might not even be worth it to spend your time much more than contacting the seller a few more times.

Was this on Ebay? I got screwed once in a similiar fashion as you. I sent a complaint to Ebay and the seller got kicked off. In my case the seller had failed to ship numerous auctions so Ebay could have had numerous complaints. I never did get any money back though.

No, it wasn't eBay. Just off of their website.

Yeah, I'm thinking I'm SOL on this too. The seller probably knows the 45 day PalPal dispute rule.


I guess what I'm most shocked about it is PayPal not willing to do anything, despite all the proof I have that I got screwed, including the seller admitting they didn't send everything.

For shame PayPal, for shame.

As Yoda once said- do or do not; there is no "try."

You need to do this in the following order:

- File the dispute with Paypal anyway.
- Once Paypal rejects your claim as it is past 45 days, then file tihe dispute with Visa.
- Then if Visa says it is too late, escallate it with them. There is no reason for them to deny your claim just based on time having gone by.
