This is contradictory. I have no idea how you, assuming that stewart deliberately acted to kill ward, rectify stating that the facts will be proven and claim that stewart will walk away unscathed.

Yes, I am bullying you by pointing out the flaws in your argument.
You will never be able to prove intent, so thoughts of "MURDER" are out the window. Hell, basic logic should tell you that Stewart wasn't thinking he should kill a guy for waving his fists. As it stands now with the facts as we know them, your best case scenario is criminal negligence/involuntary manslaughter - if you can prove that Stewart's actions created a situation where Ward could be killed. If you can convince a jury that Stewart intended to cut close to Ward or otherwise "scare" him, you have a chance. The difficulty with that is the fact that Ward put himself into a stupidly dangerous position that forced other drivers to have to avoid him. As it stands, I think there is no chance at all of a criminal conviction. But we'll see where the lawsuit shakes out.

When I look at the video I don't see how Stewart hit him intentionally, or even saw him before the last second to begin with.
Traveling at 70+ MPH, heading into a corner, with poor lighting on the track, and two cars immediately in front of him with the other guy wearing all black.
The biggest thing for me was that it occurred in the corner, on a straight away this isn't an issue but taking a corner behind other cars with low visibility at high speeds and I would be shocked if Stewart saw him before it was too late.
Unfortunate, and tragic accident, but not sure why we have to place blame on Stewart or Ward. The guy made a momentary lapse of judgement due to rage and put himself and Stewart in a bad spot.

I dont get why the Stewart is a Hot Head factors into this. Stewart wrecked the other guy by racing hard into the corner not the other way around. If this guy wrecked Stewart and then this occurred I get that arguement. But in this case Stewart is likely just looking at his next move in the race and pit strategy during caution.

There is essentially ZERO visibility out the sides of those cars. Especially on the right side where the spoiler dips down. I have a tough time reading how folks could assume malicious intent wihout any substantial evidence proving so and when the kid shouldn't have been out there in the first place, and secondly there was a very slim chance Stewart seen him before he could react and divert his course.
It was an accident in my mind until proven otherwise.

I agree on it being an accident, but as quoted above, a fellow driver says:

Graves said he didn't believe it was intentional.

Now, it was a bit silly for him to say "I know Tony could see him" because he doesn't know, but the statement implies that visibility is potentially good enough in that situation for Tony to have possibly seen him... better than zero anyway.
