I'm sure there are dozens of condo owners who'd love to give the guy a serious beating for causing the fire.

Seriously? Putting your smoke out in a flower pot in dry as hell Calgary?

He may as well have thrown the still burning smoke into a wastepaper basket full of newspaper.

Investigators officially release the cause.

Careless smoking blamed in Millrise fire

The massive fire in Millrise that destroyed a condominium building was caused by careless disposal of smoking material into a planter, the fire department said today.

The fire at the Canvas at Millrise building destroyed much of the fourth floor and other units on lower levels because of water and smoke damage. The city has said the 159-unit building -- of which 150 units were occupied -- is now uninhabitable.

This thread makes me want to call my insurance company to get answers to my questions in writing.

This is what I was told vis a vi insurance.

Condo Board insurance covers the common area re-construction of the condo exterior and common areas. Condo owner insurance needs to cover non common area replacement. Basically everything from inner wall to inner wall and floor to ceiling (in my case concrete). This includes carpet, appliances, fixtures, etc.

I think I will check my policy when I get home just to be sure

The smoker is going to have to find a less expensive habit . That last smoke is going to cost him/her millions as the insurance companies will pursue the individual in order to recover the money they have to spend. I can't even imagine how long it would take to garnish back the money. Not even sure an umbrella policy would do the trick here My kids told me the cause of loss last week after it happened......likely a smoker....yup, I think your right.....

I am pretty sure the condo board is responsible to put in the standard stuff in, insurance would cover any improvements or betterments. You can also get increased coverage called condo contingency coverage incase the board doesnt have enough insurance or the peril isnt covered.

I couldn't agree more. Smokers flicking there lit cigarettes out their windows onto streets, (or my car), blocking doorways to buildings and littering our city and parks with their cancer sticks and ofcourse the lady next to my office that sprays a ton of perfume on herself everytime she comes back inside after a smoke......absolutely useless! I think this person should be held liable and pay back some of the damage for his irresponsible actions and useless addiction.

No charges in massive Millrise condo fire

No one will be charged in the Millrise condo fire that left 300 people homeless, after the cause was deemed to be an accident.

Last Thursday's blaze at Canvas at Millrise was caused by a lit cigarette placed in a planter, fire department officials said Monday, as the condo board has already begun discussions about rebuilding the complex.

"Charges are not pending," said fire department spokesman Jeff Budai.
"The reason is (investigators) believe there was no intent to ignite the entire building on fire. It was accidental in nature."

So can people affected by the fire still pursue civil action against the person that did it? Will the insurance company of the building and the insurance companies of the people who have content insurance go after his insurance company?

Even if all the people effected by this fire and their insurance companies go after this guy, whats to say they will ever recoup costs? It he doesnt have a liability policy... wouldnt he just declare bankruptcy and never have to pay anyone back? I am not sure if this is what would happen....but likely he could be deemed responsible for millions of dollars by a court, but if the guys has no money, no one gets paid?

Cause was deemed an accident? How about ignorance and stupidity?

Edit: People get charged for lighting forest fires and brush fires accidentally. Where no humans were displaced, property destroyed and pets weren't killed...

I don't get it.
