Lets forget about the possible side effects of the radiation (and I agree very low dangers). The fact that you have the government shooting x-rays through your body without your consent is much different than having someone wait in a small room to poop. Also, you have to take the person to a hospital, waste time and resources getting into the x-ray room. The x-ray may not even pick up the substance in question. Then you have the privacy issues of x-rays revealing possible medical issues/history of the subject.

IMO using an x-ray is much worse than waiting for someone to drop the kids of at the pool.

I'm going to base my guess purely on stereotypes. The SCC denied leave to appeal, believing that if even the quasi-conservative ONCA found an unsaved breach, then the ruling most certainly should not be disturbed.

Failing that, the SCC gave leave to appeal, but denied the appeal.

Well, if nothing else, this discussion has taught me a fun new euphemism!

I guess for me it's a personal preference--though I could see either being a violation of privacy if due process were not followed.
